Sometimes the rivets where the copper springy thingie is have a spot where air can pass. Also, sometimes where the handle on the top piece is sealed leaks air. I have had a couple that leak where the body that holds water leaks around the seal, and I've used silicone to seal all of those spots on one or another of my waterers. If it can leak air, the water won't hold as the vacuum holding it in is broken.
Katy's right: If it's newer and you can return it, do. If not, look for the kitchen-safe silicone, and let it bake dry in the sun for at least 2 days before applying, then bake 24 hours afterward so it gets a great bond.
