If the siren was not on and you are focusing on the road in front of and considering the speed of the cop car the other driver never saw him until it was too late. 1.5 seconds of siren is not enough time to react. I myself have had cop cars come flying past me with lights but no siren and never knew until they pulled past me.
 
I don't disagree with that at all. I simply stated that according to the way the law is written, the person driving the emergency vehicle should have the right to presume, that isn't saying that they should.

I work in EMS, as a tech in the ER. I am in nursing school, cross training to be a paramedic. The man I am going to marry is a paramedic. My future father-in-law is a paramedic. I am no stranger to emergency vehicles, particularly ambulances. That being said, many of my friends and loved ones are emergency response personell and I feel like people need to be more mindful of their presence on the road. Nothing irks me more than to see someone NOT yeild to an ememgency vehicle, LEO, ambo, or fire. I just want to reach in their vehicles and shake the tar out of them and ask, "What if that was your loved one needing emergency assistance? Wouldn't you want other motorists to yield??

I just feel that if the person in the non-ememgency vehcile had abided by the law as it is written for that state, this accident would not have happened.

Perhaps one could say that legally, the police officer should not be held responsible, but he/she could have made better choices as well.

Sure, everyone should yield. I wish everyone did, but that takes time an warning an even then not everyone does the right thing. But its you, the person with the lights on your roof that is held to a higher standard. When you turn those lights on you know you have to deal with traffic an have time to make choices. The people on the road in front of you do not have that lead time. And you are the professional driver with the extra training. They are not.
 
Obviously, the car in front should have yeilded to the police car, but the cop should have used more caution. The driver probably should be cited, but I blame the accident on the cop.
 
I was taught to look in my side mirror and rear view mirror when turning left. Someone said earlier about crossing a yellow line... any time you cross that line and I mean anytime, you are at risk and better make sure it is clear. They both are at fault but you most likely are not going to get a cop ticketed.
 
I would like to point out that according to one of the reports, no one was seriously injured.

That seems to be the most important thing here, IMO.

i also wanted to say that at dusk, with lights flashing that closely behind you, they are definitely in your rear view mirror and bouncing into your face. there is no way to miss them at night. day time? thats a whole nother story!
