A restraining order should help; anti-bullying laws and orders should help; in my opinion, you should demand that your daughter be able to attend school without fear of encountering this other child. If that means the other child may not enroll in that school, but will be forced to attend elsewhere, so be it.
The other child needs, at the very least, intense counselling; are they waiting until she grows up and commits more crimes? Far better to address the issues NOW when there may be some hope for rehabilitation. If that child had assaulted someone with a weapon, would the law stand idly by? Perhaps this is a case of the two children saying that different things occurred, and there is no evidence to back your child since there was a significant delay between when the assaults occurred and when she reported them? I cannot imagine, as a parent, moving my child next door to someone who had accused my daughter of a crime, even if I believed my child innocent.
