Who owns this property next to you? Can you look it up at the County?

Maybe you could get ahold of them and let them know the extent of the dog feces and tresspassing going on. Maybe even offer to post the poperty for them with those no tresspassing signs that say violators will be prosecuted. Then any time you see someone out there you can call the police.

Just a thought, signs are cheaper than fencing.

Ed, that dog was on your property going after your loved chickens, that dog was in PREY DRIVE mode...when a dog gets in that frame of mind..even the sweetest dog has been KNOWN to bite a human...you did what you HAD to do at the time it was happening..
Were your children there? That makes your shooting to protect even MORE valid...you were protecting your family also... that dog could have went after your family next. It was on YOUR property after blood. That dog wasnt known by you....you had NO reason to trust that dog wouldnt bite you or your kids....it was attacking pets on YOUR property...
No judge should fault you...thats just crazy!

Thanks for asking.

I have hired an attorney ($5000) and are going through the start of the civil process.

There is no truth in the way they are trying to attack me or the way in which they have written their complaint. Their attorney just wants to try to make this a case to change the animal laws and has his own agenda.

My attorney wants me to keep things low profile because we are counter suing.

We can only pray the court sees through this joke of a lawsuit and slaps both the Gapp’s and their attorney.

Since the incident, their ability to perform and enjoy their usual activities, including family and work-related activities, has been impaired due to the incident. Each has suffered emotional distress and despair affecting their psychological development, as well as physical manifestations there of including, but not limited to, nausea, sleeplessness and physical stress as a result of the incident.


Do they have doctors documentation stating that their illnesses are attributed to you shooting their dog? Next these people will be filing for disability because their unable to perform day to day activities.

Yes they spent so much energy and time with their companion that they couldn't even bother to walk with it and instead turned it loose to go play in traffic. Unfortunately the plaintiff's didn't exercise their right to control their dog.

Plaintiffs reserve the right to plead punitive damages in this action at a later date.

Yes, I think some punitive damages are in order in addition to paying the legal fees of erafter's attourney. Oh wait- that's not what they meant.

Ed I am so sorry you have to go through this. I was afraid this might happen after accepting the deal. Best wishes for you. Let us know how things go.​

Dear lord man, you have got alot more patience than I do. I woulda shoved his court papers where the sun dont shine (and none too gently if you get my drift).

When I moved to my homestead (80 acres) I was told that off leash (roaming)dogs are not allowed and if I chose to ignore the rules and my dogs were caught harrassing livestock they would end up dead, and I would be fined. I had no issues with the rule as I built them a 20x20 chainlink kennel and they are either in thier kennel, supervised off leash(well trained GSD's) or in the house.

I'm an animal lover but I am also a live and let live type of guy. If this was happening at my place every dog that entered my property would be caught, and sent to the pound. That is if my GSD's didnt get them first. ie if you let me live in peace and follow the rules then everyone wins, otherwise bad things happen to stupid people.

PS my dogs are not vicious, they just know that strange dogs do not belong on our property unless formally introduced. I unfortunately can't tell a feral dog from a pet dog at 100yrds and neither can they.
