Fighting Local Ordinance

Hi guys! I have owned Agricultural Property since early 1990's but in 2017 they change the ordinance to eliminate Roosters. I have had my rooters for years before that but as new people move into our rural area, that don't really appreciate rural lifestyle, things are becoming difficult. What is the best course of action in fighting this?

I would like to think you would be “grandfathered” in.
I personally think if new people don’t like roosters, they should’ve moved somewhere else. By my local ordinance office has assured my that my opinions are irrelevant. Bust of luck to you!!!

I would hope you are grandfathered in at least with your existing roosters. In terms of fighting it, perhaps propose a middle ground such as roosters are allowed on lots over a certain size and banned on small lots (where neighbors tend to be closer). Alternately you could propose an amendment to say roosters are allowed on Ag zoned lots and not on Residential zoned lots within the zoning district. Show that you've put some thought into it and and are willing to compromise. I'm sure there are others beside you that are impacted by this ruling. Perhaps look at a zoning map and see how many lots in your area are adversely affected by this, you can then even reach out to those specific homeowners.

You should definitely be grandfathered in. I can think of 2 options. You can call an attorney or....make you a really big sign that says roosters for sale $500 each. They will probably tell you that you are not grandfathered in hopes that you will cave and just rid of your roosters. I'm willing to bet money that you are though. My ex in laws got to keep cows and pigs and roosters because of the grandfather clause. They just didn't get invited to neighborhood get togethers much.

I wish I knew... but I will suggest that I've heard the term "grand fathered in".

Just doesn't make sense... when we did our research and bought where was appropriate for us... for them to try and take away our investment in our future. That is the WHOLE point... if buy next to a bus stop, airport or grade school you deal with their traffic and other issues. The seller disclose those things are there. And you do your diligent homework during escrow not to buy next to a crack house if that isn't the lifestyle YOU wanna pursue! Don't buy next to my home where I have been LEGALLY raising my animals for years on end and then complain my rooster crows as loud and often as your annoying little yapper or other obsessive barking dog... and screaming kids, and loud arss nagging hag of wife never shut up!

My new neighbors (bought the house across our little dirt road) said to me... at least your roosters don't crow at 4:30 every morning.... BUT WAIT, they do! None of my neighbors had roosters when I moved here. And one expressed to me (when my newly weaned and separated from their heard goats were raising some SERIOUS cane) that she sleeps with her window open. So I waited until later in the morning to let them out. I also wait until 8 to let my roosters in the stag pen out of their side of the barn... though most the crowing takes place before that the barn dampens it some and I do want to leave in peace with my neighbors IF possible.

Seriously, before I spend $100,000 or most likely more to buy a place I wanna KNOW I will be comfortable there.

To the people moving in... I will try to be considerate of your life... but DON'T think you can run mine, I paid my taxes too... I expect the same consideration.

Restrictions increase property value, which in turn increases tax revenue.
A subdivision popped up a 1/2 mile (as the crow flies) from our local drag strip. Yep...oh did the noise complains start rolling in. It's still in operation but they close at 8pm now.
My sympathies go out to ya. I hope you are not affected. Just fight best you can and learn everything you can about why things changed.

more. It’s eaiser to put up with one person that’s right than to deal with the twenty that are wrong.

Not to get political but this is why we have the electoral college. And we don’t run things by mass. Everyone has to be represented. How many people would be up in arms if people started telling people you can’t have dogs. Or your kids can’t yell in the yard. Chickens even roosters are not even as loud as that.

My neighbors have annoying kids and a filthy yard that’s an eye sore and when I put up my chicken house asked if I had a rooster. I can’t have roosters but your kids yelling all summer at each other has woke me multiple times when I worked nights. Or your yipping dog. Or your offensive smoking constantly on the back porch that comes into my backyard and in my house if any window is open. Or your new dog that sits watching my girls thinking of how to get to them. I didn’t say anything but you aren’t the best person to live with. I would love to rooster you for few days....months....years?

I can just barely hear my rooster when sitting in a room near the back. My coop is 200ft from the house. In the mornings he crows for a while in the coop which further muffles the sound. Roosters catch a bad rap and y'all are right they are far less irritating than some teenager playing his car stereo at from 10 til midnight.
