The neighbor's fence being to "close" to the road is ok because his is all metal t posts which would bend over if some one went off the road. But I guess wood posts can do more damage/cause more issues if someone hits them.

Wow, that's a new one. You have to be responsible for others' poor driving?
aint that something wishing ? look up the law. I believe it should be like 18 inches from the road. City always has a right-of-way but thats all it is a right not an ownership. He dont want the fence there I would change the posts and saw the wood down. I wouldnt move it just to make him mad. do a double fence if you have to.
that sounds like way too much . how wide is the road ?
