Heartbroken need advice, please!(long post,sorry)

Just go over and get your property when your neighbors aren't home.

If everything you've said about your neighbors having warrants out for them is true, I'm sure they aren't going to cause any trouble with the law for taking back your own property. And even if they do, you can say they just flew back home where they came from in the first place. The law is not going to take the time and expense to prove otherwise over a couple of guineas; just make sure no one sees you do it.

It's really as simple as that if you want it to be.
 
I agree with Michelle on this one. If the Sheriff wont do anything about them stealing your birds, they probably wont do anything about you and your DH going over there to get them back. That guy is lucky it wasnt me because I would have punched his face in if he said anything like that to me. I go nuts when I get mad, it can come in handy sometimes. I would be calling the Sheriff's Office non-stop and if needed, I would go down there and bug the crud out of them. I would NOT stand around and just let it slide. Im not saying you are doing that, Im just saying I wouldnt do it.

First of all, I would call the Sheriff's department back one more time and tell them if they do not get your birds released from the people who "stole" them, you are calling the news. And then DO IT!
Also, if they say well the pen does not have a top on it, say true, but it does have a door. Someone had to let them in and shut them up. So tell them to open the door and my guineas might be able to come home because they cannot fly. See what they say. Also, if you get no response after all this, you can find out who the district attorney is for your county and go in and file a complaint with them or the Internal affairs.
BTW, what happened to this lady when she came after you and your husband with a pipe? Was she arrested? If not, why not? If you didn't call the police that time, she probably figured she could take advantage of you again this time. Its too bad that this goes on in a lot of situations, not just this one. I remember one time my daughter "seen" her bike get stolen in the city, and she seen where they took it. She took the police over there and the kids refused to open the door, so needless to say, they said there was nothing they could do and it was a new bike. Sometimes it seems like the criminals and misfits have more rights. Maybe you need to get a pipe and go over there and take them guineas. Just kidding? But I used to be that way when I was younger.

All I can say is that it's been a week, and nothing is getting done. These people need to give your property back or you need to file some sort of litigation. The guineas could fly out if they wanted to, yes, but they are your property and you want them back whether they fly out or not. You want them back NOW! if this were a dog they would have no issue with it. Legally you have a right to demand your property back RIGHT NOW! Tell them you want them back and don't let them tell you otherwise. The sherrif is busy, they're understaffed, well, if they helped you clear this issue up they would have one less problem calling them all the time. Honestly, after reading all these posts, I don't think this is so much about the birds anymore. This is the priniciple of the matter. This is not the wild west! You have a receipt for these birds! You want them back NOW!!! I would be throwing a tantrum if I were you! Tell the sherrif you are getting your birds back and that you want someone there to keep the peace, then tell the neighbor you want them back. Tell her they are your property and you are demanding the return of your property RIGHT NOW. The sherrif cannot tell you otherwise, because it is within your rights to demand the return of stolen property. Ask them both if they want you to hire a lawyer, and tell them you have everything documented with photos and your receipt, and they can either give them back to you now or suffer legal litigation. Whatever the case, something needs to happen soon, because time is of the essence with cases like this. If you wait too much longer the judge will ask you, why did you wait so long? You'll have a reason, of course, but it would be nice to skip whatever delays you can avoid. JUST PLEASE DO SOMETHING!!!! TELL US THEIR NAME AND PHONE NUMBER AND WE'LL ALL CALL THE SHERRIF FOR YOU!!!!! (BTW, is anyone here a lawyer????)

You might want to tell the sheriff's dept that the fence they have your Guineas in has been modified to keep birds from flying out.

I know my Guineas always get next to the fence and fly straight up to get out, if your neighbor's fence is curved inward, this would prevent them from flying out.
In my opinion, this is containing them.

You have a receipt? And I'm sure they don't.....so, you need to call the local magistrates office and find out the procedure of getting your livestock back. First go to wherever you purchased them and have the seller write a description of the birds and sign an affidavit of the sale, the date of sale and include their phone number. What they did was illegal and the sheriff has to act on this, if only to file a report and let you take it to court. You file with the magistrate and take these people to court. They will have no proof of ownership and you will. Do this immediately, don't waste any time and be firm and clear on your intentions. File official charges with the sheriff's office for the theft of these animals. Make some noise, shake people up a bit, the mere threat of having to do paperwork often will make officials take action.

Are they renting their home? Contact their landlord and describe their behavior, explain his homeowner's insurance will have to reimburse you if these animals come to harm on his property. Urge an immediate resolve of these issues or threaten to sue. Sometimes, the squeaky wheel gets greased! I'm sure THEY aren't making much noise, they feel like they have won already!
 
Update....

Sorry for not posting an update sooner. As I was at the drs. office most of the day Friday I did not get to call back to the gentleman at OK Dept of Ag. Did not get good news but that is off topic.

So to Michael and Sonny...We heard them for the first time in a long time last Thursday night, but we could not figure out where they now have them. Definitely no where in view. But we haven't heard them since. One of our other neighbors saw some people over there later that same evening and they took out a pet taxi and loaded up something and left. They do sell some of their baby goats and such so there is not much telling, but we have not heard the boys since then. So we suspect they may have sold them. If that is the case, I am torn between being mad that they made money off my boys and happy that the boys will not be in that environment.

If any thing changes or if I learn anything new I will post ASAP.
