I'm so sorry that you have a psycho neighbour...and that he's making your life hell...
If you're within your rights, Tim doesn't have a leg to stand on, no matter if the sheriff's dept doesn't have the cojones to do what's right. I'd get Law Enforcement involved and also go to the local newspaper...sometimes stirring the pot does some good.

some times the law can be on your side.....tim's buddies told the sheriff what to do and the sheriff told them off, my husband calls them "bunnie huggers" .....i'm one too.......but i know where to draw the line unlike tim, our other neighbor on the other side of us is a great guy and we hardly ever see him except for plawing his field and he didn't have a problem with our horses.... tim has sort of dug his own grave on this one all the complants came from tim's side of the fence not the other, any ways i'm taking thing's step by step, the horses are leaving tomorrow after noon, by tuesday the t post by his line should be 5 wired by barb wire and painted purple (no tresspassing color) pic's will be taken of every horse for future court cases against him, and trust me he will see his day in court, tim is already in a court case against him right now but i'm next in line i think with him, a nieghbor futher down the road has offerd the use of her old coop will we thing's worked out, i just want to get my coop done, my 11 month old son just loves to watch the chicks, he loves how cooky goldbug and bailey look ( polishes) and i want them to be able to live in pease out side in there own coop

So, exactly WHO ordered you to get rid of your horses? And where are they going? Can you get them back if you win a case against Tim? And I really am not clear on why you are getting rid of them since you are clearly on the rural side and not the city side-unless it really is illegal for you to own them?

There is no way I would let anyone force me to get rid of my animals if its legal. Did you try calling the local news station? Many times they love to get involved in helping "the little guy" in cases like these.

Can you recap this situation as I have read the whole thing, but still don't understand why you are letting the horses go if you are legally clear (does the Sherrif override the laws?).
 
Well, I would make someone come get
my animals...and they better have the proper documentation, and have served all the correct notices and warrants, and gone through the correct due process...

Even if the sherrif told me verbally to remove my horses, that doesn't seem as if any of it is being done legally, and I would seriously question it before I hauled away my own animals.

I still don't get it... what does the amount of hay the horses eat have anything to do with getting rid of them?
 
it was totally ilegally on what our sheriff has done, you right there was no warrent severd, and not a court document written, but in order to save my husband from being charged with a felony are herd went to auction and sold ( all 4 horse for a total of $ 108.00 for all ) i was in tears, not for the lost of over $ 1.500.00 they were worth , but my pasture pet's a gone.

my border has left 1 horse for a while (we have a court order stay for her) a big grey mare, and my 2 horses are still here , i have made copies of the sale sheet (one went to the dept, 1 i've hidden for my law suit (yes i'm suing) i will be suing tim for all he's worth plus more and his buddy too... i'm also asking for a restraning order to be issued against tim's family , so much for his wifes job at my daughters school, this mess started all because tim didn't think we had the proper grazing area for our horses, we have our vet, our border and a 4-h horse person on our side,

it was my 4-h friend who told me to get my ducks in a row and sue, i'm taking my video cam and with promision and will be filming most of the places that have horses on there farms to show that hardley any one has grass area for there horses and after that is done, i will take my sale sheet and do every thing i can to find my horses and bring them home.
