Curious, what felony was your husband going to be charged with? I didn't think they could make up a felony -unless there were grounds for a felony charge?

Taking video of other horse farms/owners is a good thought. But in practice will it help you any? If it is against your laws to own horses without grazing pasture, then you will only be showing the courts that everyone is illegal as well as you may have been. Just because "everyone" does it, does not make it any more right for you.

I am asking in sincere interest. Because, if what you say is true (about the sherriffs' verbal order), then everyone with pets or livestock needs to be very worried also that the "law" could just scare us into getting rid of our animals.

I guess, bottom line, by what you are implying, is that it was wrong to own horses without grazing pasture, and that you want to justify your actions by showing that other horse owners are in the wrong also. So this is really an issue of: Everyone else is doing it, but I'm the only person that was forced to comply with the laws.

You may correct me if I am assuming wrong-it just seems as if there are too many holes and gaps in this instance.

Maybe the Sherriff was being kinder to you and hubby by just verbally telling you to comply with the laws before a felony charge is filed?
 
I'm sorry, but the way i see it is that this "sheriff" is on a huge power/ ego trip! Also, correct me if I'm wrong but aren't most sheriffs ELECTED to that post? If it were me i would be getting as many fellow citizens as possible on my side and maybe get a letter campaign started. public awareness is the key. There may be not much you can do now to change the situation with this clown but after all he was voted in, he can certainly be voted out! I also understand how the proverbial "good ol' boy" network works as i live in a small town also. If this "Jethro" is as you say he is its time to exercise your rights as a tax paying citizen and allow due process to work on your side and not against you! If he is doing as you say he is.. he's done it before, and will continue to do this in the future if not contained. I have a horse and both of her pens are void of grass. I have a friend who has 2 horse on our property and her pen is also void of grass. They are fed two flakes of hay and two scoops of feed daily. I dare someone to come on my property and tell me I have to get rid of my horses! I don't give a rats
a*s who they are! My horse are in great health as matter of fact my friends horse Sara was 200 lbs over weight and had to be put on a diet. I would sue him until he bleeds. Good Luck who bought your horses? They didn't go to meat dealers?? I would make him pay for emotional distress too!
 
thnx for the replys.... first off it is not illegal to own horses and not have grazing for them, horses can not be denined food are water, we had constent hay for them when every they wanted and a 110 gallon tank full of water all the time (filled at each feeding), here is tim's problem, tim is bipolor and skisofrinic (don't think i spelt it right) and a very dangerus man, he can be friendly to you one moment and a complete lunitic the next, he is so peranod, he changes trucks aften, we are ( my border and i and a few people who know him) trying to pin point what started this, my border's horse once got out on his of the property when she first got here, she was promply put back, since that it's been down hill from there, our fence lines have been cut on his side (3 wire, hot wire barb and hot wire) all cut straight down in a line, and tire tracks on his side of the fence, mean time on the other side of the pasture there has never been a brake in any of the wires, but yet we were the ones to get in trouble, in the mean time my daughter is very heart broken that her pony is gone and my husband doesn't talk about his beloved horse any more. i'm hoping to cut a deal with the sheriff's dept and not name them in the suit if they follow through with what i want.
ivy 2 of my mares......a chestnut and a buckskin sold to a mustang dealer and went to co, my daughters pony went to a mexican family (local) who wanted to buy her off our trailer at first but got in the ring a lot cheaper then my asking price, and my bay mare went to a fat old cowboy who laughed with his friends when he bought her for $15 bucks, she sold as a yearling and not the 3 year old she was.
i didn't let my husband take my chickens there, he'd have to kill me first, but last night after feeding them i just sat there and watched them, how corky they where and how very inosent they are in every way, i know my coop is being built with recyled stuff but i'll spend the money to put alerm in it as long as tim is around.
for the past 3 nights tim has been ridding around in the middle of the night in his tractor just going up and down on the far side of his proprerty, were not sure why, all his hay has been bailed, but yet he's there each night till about 1 a.m, if i need to go out at night i either take my dog...(blind as a bat and will grawl at every thing and sound mean) a empty .22 (i know how to shoot it but feel better it's not loaded) or wait till my husband get's home to check on the 3 remaing horse left.
 
ok there's some good new's about this, i thought my husbands and my horses went to a dealer in co, well..........

we were out all day and came home to our phone ringing, it was a really nice woman wanting to know the names of the 2 mares she bought, it was my bay mare that went to the dealer, she said that if she hadn't of gone to the wash room she would of bought all 4 horses...lol....who knows she might find that one...she found us, and she sounds really really nice and friendly.
my huband is starting to get the bounce back in his step and was working on the coop for a bit this morning...it was to windy to really do much...all i have to do it get my stuff inoder about tim and go to court

There may be more laws but thats what I found in a quick search. Do you know if your fence is legally a partition fence? If so, he may have just purchased 1/2 of the repairs on a fence he himself may have cut. Bet that will really get him going if he has to pay 1/2 of his own vandalism.

If your fence is a partition fence, you should get in a fence viewer ASAP. In fact, have them come out anyway, they will tell you if you are incorrect.

Well, i think the problem that everyone is missing here is the bi-polar and schitzo part.
We all are quick to think of our rights and protect our pets........but 'TIM' is not going to care about the law when he snaps. Most people who commit the most horrific crimes are suffering from a mental illness........that would be 'TIM'. To stand up to him would be a challenge and make it worse. I fear the word bi-polar. Its a very sad situation but i would be as nice as possible to tim and find a way to plan selling and moving.
If i were in that situation, i would be sure the chicks were not going to be free. Fence them in or find a home for them yourself so you know they will be ok. You have my sympathies.
 
As much as I feel your desire to protect your flock and your rights, I have to agree with Lurky. If you were dealing with a sane person, your approach might be warranted. But this is no ordinary dude. We don't want you to end up as a statistic or on the front page of your daily paper. Try to lay low and get some distance between you. Protecting yourself and your family must come before your flock. Anyone who would do something to them is only a step away from doing something to you.

I understand your situation completely, we have a neighbor that is also bi polor, he lay down in the road in front of my granddaughters car so she had to stop and he wanted her to take him home(He was in front of his house). she was terified of him, I think so many of the neighbors complained that his wife finally broke and had him commited to a hospital. In this part of tn if your great great grandfather wasn't born here, your an outsider. Our county is growing fast somaybe the newcomers will be able to break the GOOD OLD BOYS network and we will begin to grow. I think you need a new sheriff, why don't your huband run, you need new blood in your town to:mad:
