How to handle with person selling sick birds *RESULTS IN *

Report came in. Both had respiratory problems. Which is what killed the one. It would have killed the other one . So it is no lnger slander to say my friend was sold sick birds. The seller still is nasty and wants both copies of the report and then she will" think "about giving my friend her money back. My friend is out another 100.00 for the testing. So I advised her to not meet the seller since e seller wants the report which has my friends personal info. Seller asked how many copies of the report their was. My friendd is honest and said two. Seller then told her to come by and give her both copies . Then she would think about refunding her money. I think this is how this lady does busness. However I plan to scan it and black out the information and I am advising her to sue the seller. The seller knowingly sold sick birds because she saw my friend was new to this. She knowingly took advantage of her. I tried to talk to the seller per my friends request because the seller is so nasty. The seller refused to talk to me , was nasty and unlike anyone I have ever had to deal with. This seller clearly most not make her money by repeat business. She knows darn well the birds had to been sick at her plac and now we have proof. I am going to scan the report , and also post it to all the local feed stores. This seller is selling birds with oat of issues according to the report. I can not believe city of Norco still allows this women to have a business license. Ham and eggs is surely a avoid at all costs. If you buy from her buy at your own risk because she doesn't stand behind the birds she sells have a clean bill of health.
Tomorrow we call animal control with the report in hand. What else can my friend do ? Shes out a lot of money at this point.

Don't know where you are from, but where i live these kind of things get reported to the animal health commision or livestock comission selling birds with these kinds of ailments is a serious thing here in texas.
 
We are in California . Worse yet she is a business!! Any other honest person would have refunded the money and taken the remaining sick bird. The seller refused to do that so both got sent for lab testing. Even after the seller was told in fact they were sick and the seller again refused. Its really unbelivable. Since I have proof , i can now post it at all the local feed stores. Which will be done. My friend gave the seller every single change to redeem herself. What is so sickening is every time I drive by she is selling birds over her fence. More sick birds out there , get other birds sick. Its wrong ! I'm going to protect my flock and my neighbors because who knows if someone near by will be buying these sick birds. This lady sells alot. She even on her site says she provides healthy rare birds. Lol guess she wouldnt get business if she was honest.

Can always post at feed stores, go to the animal control, health commission and better business bureau. Additionally you could try to sue in small claims court. One thing to check is with the respiratory illness what is the incubation time, strain of disease, typical time from infection to death etc. so you can prove beyond a doubt that the birds were infected when sold. I am sure an unscrupulous seller will deny many of the statements she told your friend about the noise the bird was making. They will claim it happened under your friends watch. The whole situation just sounds really stressful to you and your friend, owning peafowl should be so fun, enjoyable, and exciting!!!! I think all your friends on BYC are behind you and think you got a raw deal, but please don't give up on peas!!!!
 
Myosotis , neocrosuppurative, Focally extensive,suggestive of injection site (did she at some point try to inject them? I didn't ) nasal mucus content. Dermatitis , fasciitis and necrohemorrhagic myosotis, severe ,pneumonia, Focally extensive with lung left consolidation.
Mycoplasma gallisepticum - positive ( no way did it contact this and die in a few days in my hands) she knew they were sick and figured 100.00 each bird and my friend would be none the wiser. Only my friend knows me and I know better. Otherwise her entire flock would be infected now.

So will know even more once blood work comes back. If it comes back it could put her out of business. I'll see to it city gets copy's as well as animal control. Seller was given the chance this to not happen but guess 200.00 is worth it to her. And oh yes results will be posted at anyone with a message boards , so that means all the shops in my area. Sure feed stores would love to know so they can inform their customers.

Incubation
6 -21 days. She didnyt have the birds but a week if that.The one was clearly sick from day one and my friend asked her about it. Lab says the one was the dad which died first. So she also lied about age of the one peacock. Also both had no tail feathers. Does this mean they were kept in a tiny pen or crate ?? The tail feathers were all broken off.

Regardless these results are not all the tsting but think this is enough to get her cited and closed down.

I just found this thread and although I don't have peafowl, I have to put in my two cents... the seller was WRONG! And is still working an angle by requesting both copies of the report. Do NOT allow your friend to give the originals to her, no matter what the seller says. Do as you mentioned: photocopy, black out ALL of your friend's identifying information and even the report number, etc., then photo-copy again. Give that last photocopy to the seller IF you are present with your friend and IF you can meet at the seller's house. Do not let your friend be swayed.

Highly doubt seller will agree to it.

We recently had a problem with a seller of chickens and before that, a seller of nigerian dwarf goats that lied lied lied about stuff. Nothing nearly as bad as what you and your friend are going through.

Think out your steps carefully. Do you want restitution? Do you want her shut down? Step lightly to avoid the slander thing against you. For every accusation you want to bring up, you need to make a notation of what paperwork you have to back up your claim. If you don't have proof, then get some. If getting some is impossible, then back off that point, and go to the next one.

Just realized ... you said you quarantined the peafowl when you noticed something different. I'm hoping I just read that wrong. If not, and the sick birds had any contact with your own livestock, keep a special eye out on the health of yours.

Hoping your critters are safe and healthy, and that your friend has a result that she wants.

She came directly from the seller to me. She wanted to show me. I grabbed the birds and straight into quarantine they went. Never having contact with my flock. I then came here and treated as directed. The one was barely able to breath when she brought it here, i gave it the five days to treat with tylan 50 by mouth. I never injected them with anything. but the report says both had injection sites. So I assume she treated them with something but until blood work comes I cant say. At this point it can be proven by just the incubation time the illness they came sick. I will be sure my friend doesn't get swayed , I already told her to not give the seller anything. But i did call the seller as per my friends request. She was not happy about not being given the reports. At that point she said she would not talk to me any longer unless I had power of attorney. Where then she proceeded to hang up on me. I am not a push over, I will see to it my friend files everything she can. I want people to know about this lady. She's not honest and worse she is putting others flocks at risk encase she cares more about the all mighty dollar over the health of her birds and the respect of the consumer.
 
Looks like you got all the info you need to sink her. I wish we could trust people more, that is what the world should be built on. Poor birds, rotten seller.
