illinois towns that allow backyard chickens

I wonder if a higher court would ever uphold something like that. IANAL, but that seems contrary to the founding principles of our nation.

I guess i should say it is just the "default". In the case of Dupage county, it is written into the code:

37-403.5: - USES NOT SPECIFICALLY PERMITTED IN DISTRICT/PROHIBITED.
Except as hereinafter provided, when a use is not specifically listed as a permitted or conditional use in any specific zoning district, such use shall be expressly prohibited.

That's lousy.

There are five Government Models in Eruope:

The English Model - All is permitted, except that which is forbidden.

The German Model - All is forbidden, except that which is permitted.

The Russian Model - All is forbidden, including that which is permitted.

The French Model - All is permitted, including that which is forbidden.

The Italian Model - It all depends on who you know. (that's also the Chicago model)

Urbana allows hens, but no roosters, and Champaign doesn't allow any. Penfield allows them, and so does Paxton, from what I hear. Haven't actually looked up the laws there. I live outside city limits, so none of it applies to me :)

Actually, Urbana does not have any laws prohibiting either hens or roosters. Roosters are permitted but are subject to nuisance laws and animal control is quick to issue warnings for the exceedingly vague nuisance law under which they are covered. We had a rooster for 6 months, until one of the neighbors complained and AC left us a nasty note stating that we had 24 hours to "correct" the problem...although it was never specified what exactly the problem was except that the rooster was crowing (which in and of itself is not necessarily in violation of the ordinance that was cited). I know someone on Michigan who has had at least one rooster the entire time he has had chickens...which would be going on 4 or 5 years now, and never a complaint from the neighbors. Champaign and Savoy specifically prohibit chickens, and Champaign recently voted down a proposed ordinance change that would have allowed them.

Wauconda, IL: no chickens unless zoned Agriculture. Apparently you can keep them in unincorporated Wauconda. There are a couple of chunks in Wauconda that aren't part of the Villiage, including a section on the lake off of Garland.

Lazy Susan Farms has a small commercial egg farm at the corner of Garland and Bonner Roads. It's part of the unincorporated chunk, so apparently they follow Lake County ordinances.

Unfortunately, my home is in residential, so no chickens allowed.

Hay All,

FYI Mundelein, IL is considering including Backyard chickens and Apiaries in their new city planning.
They are still mulling it over. Tomm there is a village board mtg, and I will go and start making a case.

If you can, please attend (esp my wauconda neighbors!) we have a chicken sticker for the supporters to wear, and you don't even have to say anything. Just be present.

if you cannot attend, you can send an email to the village contact [email protected]
and thank them for considering back yard chickens.
All positive vibes!

here is the page w/the info:

I live in Melrose Park too. I'm not in unincorporated though. My neighbor across the street had chickens, but she is in Northlake. I'm in a little forgotten subsection. I'm thinking of just going for it. Let me know your experience.

if you live in a little sub division you live in leyden! if you call up theyll say no if you call northlake they will say no. everyone says no...however all the people say yes. we went for it built the run and coop behind tghe garage and ignored our laws. we are not alone, if you wake early enough a couple blocks down you can hear crowing! so far no one has said anything. and ouchicks are happy. but its always a risk!! but id say go for it

I'm looking for the Wauconda code or ordinance that specifically states that one cannot have chickens in any area but agricultural. I just cannot seem to find it. I did find the definition as stated above as well as some nuisance code but nothing said chickens are strictly prohibited.

Anyone? PLEASE help!
Our lease is up. We'd hoped to move in two weeks (the house we love in Mt Prospect fell through) and haven't found a house yet in an area that specifically states they allow chickens.
We're looking at a house in Wauconda tomorrow and I'd really like to know, before we sign any documents or contracts, what the chicken situation is.

Thanks!
Cate
