Crazy Right? So I talked to the wife and went with the kill them with kindness method, said sorry for any misunderstanding blah blah and she was a total cow! She said "sorry I touched your precious lawn" in the most grump tone

and I told her it wasn't the lawn it was the boundry she crossed, trespassing is a crime. So they killed our "precious" lawn. Yup we have a toddler, birds, cat, dog and they dumped poison along 150' of our property line. Killed everything within 1.5' of the fence. Psycho's!

Where I live you can shoot humans for that...Its called the "Make My Day Law" . If someone is trespassing, you have to ask them to leave once. If they don't you just blow them off the lawn( they dont even have to chase the chickens). Still I must be getting to be an old softie, because I haven't yet tried it out.

Anyhoo seems a bit drastic on their part. Did you have any recourse with the law?

Here in michigan it's called the no retreat law, or the castle doctrines. If you have to resort to it, have a printed copy of the law available for when the cops come to take you to the hooch.

Neighbors CAN be psychos, yes, and that's exactly why you don't want to let the 3 feet of property thing slide. You're paying taxes on it, not them. The written warning, though, could easily be turned against you by an unscrupulous lawyer. Here in AZ, if anyone puts up a 'Beware of Dog' sign and their dog bites someone, they can be held liable because they knew their dog was 'dangerous'. Now I know why people go live in a cabin by themselves in the woods!
 
I would not shove that letter in his face if it were me. Just go about your normal day and take care of any issues as they come up. Then the sheriff can let him know the law if needed.
 
My issue is, if I don't give it to him and the dog comes in my yard...I am NOT going to want to shoot the dog... me telling the neighbors I would is my legal threat...but I don't *WANT* to actually do it... the fear of the recourses worry me too much and the fact that I've never murdered someones pet before. Heck, I can't even pull the trigger on a very aggressive LARGE feral tom cat that has attacked my moms cat several times...and I'm almost sure killed a feral cat .....needless to say what im getting at is, dog comes back over, I don't shoot but make a big fuss (hope to snatch my camera fast and snap a picture) then what do I do? Just call the dog warden out with picture proof?

I've had to do that before with dogs coming on to the property where we lived before, but the neighbors came over after I filed being a witness WITH Pictures, and threatened to beat my husband up because he said he'd shoot it if it came back over (the one beagle kept attacking our dog when it was outside on our property)... so hubby was concerned he'd slash our tires... so i called the dog warden back and got the court date dropped.. she was mad at me (the dog warden) and explained that I could have called the cops because they were threatening us... but we didn't feel safe.... just wonder if that will be another issue this time around... you have to go to court if you ahve proof of a dog on your property here in PA... if you dont shoot it (and ims ure even if you do shoot it you still have to go to court

as for the one who said whats 3 feet? that's my parents hard earned property, they have no right on it, and yes if they mow on our property for several years, over time that area will become theirs.. that is NOT what we'd consider not a big deal....3 feet..then 5 feet then 10 feet... no... he got his land surveyed (and we've had ours surveyed 2 times) he needs to stay on his property... we have no tresspassing signs up for a reason

Niki, the root of the issue is that the guy doesn't think his cute pooch will do anything wrong (sort of like how some parents will never believe thier precious angel ... ). In his yard it's a pet, in yours it can be a predator. Sadily it sounds like he just won't be reasonable, so which is worth more to you, your flock or his dog?

If his dog was worth it to him he'd keep it in his own dang yard.
