The bar for a "commercial operation" is actually not very high. I don't have the court cases in front of me, but as I recall even intent to sell counts - and many of us meet the commercial requirement simply by selling extra eggs to friends and neighbors. As for me, I have a very small flock (3 birds, currently), but they are a rare heritage breed and I intend to sell chicks and hatching eggs.
In any case, it is actually quite easy to establish a commercial farming operation in Michigan, by keeping a few chickens and selling a few eggs.
