Actually other than his attitude about looking for her.. she is microchipped, they do have good fencing , etc and are exceptionally ahead of the game on being a good owner from most.


I think you should give her back but tell him you've really bonded with her as you lost a similar dog and if he ever wanted to rehome her to please put you first in line. If she is a chronic escaper and he has done this numerous times maybe he was just frustrated and decided not to make a lot of effort since he always seems to get her back. There's a lot of factors here that you may not know that created that attitude. She's not your's so I would take your chances, tell him you'd be interested in adopting her and see what happens.
If it's meant to be it will happen.

And please always scan for a microchip! I'd be devastated if my dogs were found by someone who purposely didnt scan it because of one bad incident with an owner. This time of year especially people are on vacation and dogs can get lost in some very strange circumstances. My friend's dog was locked in a garage accidently when she got loose and the people that closed the garage were leaving on vacation, the dog was in there for almost a week before discovered! Another dog was picked up by some "good samaritans" but driven to a town 45 minutes away , then the dog ran away from them and was lost over an hour from home. So just because you found a dog in your neighborhood doesnt mean the dog was from your neighborhood. A microchip can get you in touch ..

I had a Border Collie that ran away from me... long story short: When I finally found him, he seemed only kinda happy to see me, and REALLY happy where he was... I let him stay with his "new" family.
ASK THE DOG WHAT SHE WANTS! Maybe she likes you...

Seriously, I hope they let you keep her. OTOH, I worry that if they tell you NO that they will accuse you of tyring to steal her in the future if she does indeed show up.
I have seen too many cases of owners not caring about their pet until suddenly someone else is interested in what they have and BOOM they care now and won't let the animal go even if it the other person can geniunely offer said animal a better home.

leaving her at the shelter and requiring him to pay a fee to get her back may just be the incentive he needs to keep a better eye on her in the future.
 
Final update:

She is back with her owners.





That said, I did ask if I could keep her, and he said that I would have to fight a five-year-old and a nine-year-old to do it. Obviously, that meant no, so I took her back.

When I got there, the dog showed NO interest in getting out of the truck. The girl (9yo) met me outside when I got there, and she showed no interest in the dog. I asked her if she wanted me to walk her inside... NO, she goes out here.

So I put the dog in their backyard. The girl NEVER pet the dog, the dog did not seem excited to be reuinited with her family. The dad and son came out, and neither one of them pet her or seemed excited to see her (and the feeling appeared to be mutual). She got MUCH more excited when she saw me come home.

The entire time I walked her to the backyard, the girl kept telling me what a bad dog she was (!!!??!!) because she would chase cats.

I actually worked with her this week on that. We take the dogs to the stable where the horses are daily, and they have tons of barn cats. Within the week, she was able to be called off mid-chase.

The family did seem like very nice, normal people, who just don't care about their dog. I gave them the information from the rabies vaccine I gave her on Saturday so they have that for their records. It also has all of my information, so they can contact me again if they decide to rehome her. I feel very comfortable that they aren't physically abusing her, but I am not happy with the situation.

I am seriously hoping that they either decide she's too much trouble (btw. getting out and chasing cats) or she gets out more and keeps coming to my house. I feel sick.

I'm sorry hun. If it ever happens again and you see the kids maybe you should ask the kids how they feel about the dog going to a new home.
If the 9 year old really thinks shes a bad, I have to wonder what she would have said if you had asked her flat out if she wanted to keep her.
