It hurts me to see this. I read through the new CFR and nowhere did I see that there would be general allowance for the home or small farm. In fact, a case can be made that it is these entities who seem to be "targets" of the legislation.

Interesting is that this is being brought about by States complaining to the Feds to solve their problem. Face it, most people are not fond of dog-sized ducks taking over their favorite golf course or school (as I've seen in FL).

So the Feds intervene with this one-size-fits-all policy, as per the norm. One lesson we can take from this is "Be careful what you ask for with the government."

Going forward, if one is to possess Muscovies, it will require the possessor to show that they are a "commercial concern." Possessing and propagating Muscovies only for SALE as FOOD is all you got. Even then, permits are going to be needed and one is still liable for censure at any time. I don't see much wiggle room

Personal use or enjoyment of life, liberty and the pursuit of happiness do not apply at this time... now move along, people.

At the end of the day it looks pretty thorough and the burden of guilt lies against us. I would like to see an exception made for the home flock, but that would require discomforting scrutiny from the 'duck watchdogs'. It is highly unlikely that we can prove our ability to control them without regular visits to our homes and farms by the Federal Duck Patrol.
And I, for one, am chary to give them that authority.

Normally, it pains me to say this, but I'll make an exception on this one: Where's the petition? I'll sign it.

I added this to the petition:

"This nation was founded on the honest pursuits of individual men and women of character and duty. We make much of that in America and this is what Liberty is about. Having the Federal government make a sweeping ban on a common farm fowl smacks of the opposite - draconian policy meant to sweep away individual pursuit.

If Muscovies need to be controlled in the wild and around urban centers, then do so. I can assure you, however, that they do not need any more control on the small farms and steads across this nation than is already being given them by their owners."

i see what they're getting at but there are invasive species that are a much larger threat. besides that is such an open ended law, whats to keep someone from raising 3 or 4 muscovies for "meat" and slaughtering them when their 9.
 
Wow, what next. We live in Maine and have had these ducks for years and I agree with the post on here about them not doing well in a cold climate without us caring for them. Plus they are an easy target for food. Ours free range and are never penned and don't go far from their food source at all.

So I'm confused. We have no intentions on getting rid of these guys and we of course can not tell them not to breed. So if you own them before March 31st you you just need a permit to breed them or to sell them or both? Not clear as to where/how you get this permit?? We will sure keep and eye on this

I was thinking about this today, and I'm wondering if it's going to affect Ohio - since Ohioans passed Issue 2 last fall, we have our own Livestock Care Board in our State Constitution. Federal laws do not supercede (I think this is the right word?) State Constitutions, correct?

So, for Ohioans, Unless our new Livestock Care Board bans our keeping of 'scovies, I think we're safe?
