here are the laws AND the Exceptions for NH

437:15 Sale or Gift of Small Quantities. – Chicks, ducklings, goslings, and rabbits younger than 4 weeks of age shall not be sold or offered for sale; raffled; or offered or given as a prize, premium, or advertising device, in quantity of less than 12 birds or animals to an individual person.

437:7 Exception. – The license provisions of this subdivision shall not apply to breeders of dogs licensed under the provisions of RSA 466:6; veterinarians; owners and operators of horse riding stables; and auctioneers, breeders or keepers of farm livestock.

What about the "keeper" part?

However, like Gypsy said, if chickens aren't considered livestock........... wait, it still shouldn't matter this is an exception to the same RSA number.... oh, never mind..

If its true and the 12 minimum was meant to protect birds in shipment and the "breeders or keepers of farm livestock" is a acception them the 12 minimum is just the way grain stores are making thousands $. Who is gonna clarify with the state?

Geesh.....you need a lawyer to decifer all this stuff. Chickens are considered livestock under the IRS I believe. How did all this start anyway? It makes one not to be bothered with chicken swaps anymore.......it use to be fun and a good thing. Now they are making criminals out of people for not following rules they themselves can't even decifer so it seems reading these posts. What about serious breeders as in chicken shows versus back yard farmers looking to sell a couple of extra birds when they have too many?

And deleting my post for having asked questions about any of this chicken swap stuff does not make me feel good about any of this going on.

In general my understanding is that the minimum numbers of animals and the lack of ability to have them as prizes are based upon perceived humane treatment--have chicks as prizes at the county fair and how many end up dead from lack of food and water by the time a kid goes home? Impulse purchase of one for an Easter Basket without thought of the care needed for the growing animal. I personally think these are somewhat flawed regulations--the intention could better be met with rather different regulations: require sellers of baby chicks to provide an information sheet on feed and care, and require that sellers have an extended return period. As for prizes and auctions differentiate between carnival prizes and raffles or prizes of birds at poultry or other bird shows.
 
Okay....so for the next upcoming "Swaps" what is to be expected on both the part of the ones selling or swapping their birds, rabbits, cucks, eggs, or chicks, AND the ones buying their chickens, ducks, rabbits, eggs, or chicks? Or doesn't anybody really know is my question or does it just depend? Or just go and find out? It helps to be able to plan for such on both sides I would believe.
