Take a look at this thread- it's older, but as far as I know the Federal law hasn't changed. I think the fines have increased though, and I do know USF&W reads assorted forums, including chicken ones. Just for info, ya know?

We have a lot of hawks here, which are also protected by Federal law. I don't free range much anymore, and when I do? I assume I'm asking for a loss. I have done what I can to make nice runs for the chickens and ducks. My birds, my responsibility to protect them.

No one gets my thread.
I can't imagine a hawk attacking my chickens, it's possible but unlikely. The hawks don't do it here much, actually I've only heard of an owl attack of someone living on the other side of town (if you can call it a town lol), lotsa trees there.
I just thought of my dog.. Another scenario! You have a chicken guard dog that attacks the protected predator. It's just not an eagle, whatever is in your area. I don't think a doggy would have a chance at a bird of prey unless turbo speed with chrome paw-pads and a stamina of.. Eh well really fast dog.
Let's say your german sheperd mix is attacking a [insert animal name here]. What do you do if the outcome is fatal?
 
Well if you or your dog end up with a dead *protected* animal it would be foolish to tell anyone .From my neighbor *grapevine* I heard of a neighbor fined after another neighbor reported him for killing a hawk. It won't matter if you killed on purpose,or say it was caught in a netting.

If you get reported you will be at the mercy of others deciding on how much to charge you with. I just don't think it will matter why the protected animal was killed,or if it was killed by you,the dog,or say your roo.Hmmmmm,a roo killing an eagle? Unlikely,but again I suppose someone could find a way to charge you.Everyone wants easy money these days.

They're talking about reporting because thats a realistic issue to think about when deciding what they would do. No one thinks you actually did that.

I personally would make some really loud noise to scare it away... maybe fire a gun (but not AT the bird), just to spook it. Then again, if I had neighbors who had it out for me, I probably wouldnt do that. They might say I shot it... Not worth the thousands of dollars in fines...

But I'm kinda thinking you couldnt really do anything because once a bird of prey has a Chicken, its basically dead. Even if it hasn't actually inflicted fatal injuries, the chicken might already be dead of fright from the experience.

In conclusion: It stinks but theres not really much you can do...
 
actually, I believe it is also illegal to do anything to "harass" raptors, IE firing a gun.

May I remind everyone who recommends SSS that the forum rules dictate that you cannot recommend illegal activities to posters, and that there is a new point system in place to deal with forum rule infractions. I personally have not reported anyone here, but I would not be surprised if a mod steps in to reinforce the rules.

Also isn't burying an animal some kind of health violation? Well burying it on your property, that is. Some guy buried his cat in his backyard and was complaining about his dog digging it up, off topic but I told him that burying animals on your property is illegal in our county. He didn't do a very good job at burying it either apparently.
 
There are different regulations for what's legal and what's not in many geographic areas of the country. It is up to each member to figure out what is legal or not legal in their own areas. We cannot possibly know all the different laws for every county/city/state in the US.
