It doesn't matter. They are automatically copyrighted when they are produced. Did you read the link I posted? Every single image in the world is copyrighted (unless the person that took it is deceased).
Yes, I read this, however, there really are photos in the public domain, seriously. For example, many photos that are taken by government employees in the course of their work are in the public domain and copyright free. If you dig through the copyright law and not some lawyer's page, you would find that information. I am involved with this as a part of my livelihood. If I use photos that I'm not allowed to use, I would be in big trouble. You have to read the fine print and it actually has to say that you are free to use it the way that you want to use it.
And, by the way, even if the person who took the photo is dead, it still might be copyrighted.
