TITLE 81. LIVESTOCK. CHAPTER 7. PREDATORY ANIMAL CONTROL. PART 4. DOGS.

81-7-401. Killing of dogs harassing, destroying, or injuring stock -- notice to owner -- penalty

(1) As used in this section, "harasses" means worries, chases, or runs after livestock, including ostriches, rheas, and emus, in a manner that may lead to subsequent injury to the livestock.

(2) A dog, whether licensed or not, that, while off the premises owned or under control of its owner and on property owned, leased, or controlled by the livestock owner, harasses, kills, wounds, or injures livestock not belonging to the owner of the dog is considered a public nuisance and:

(a) may be killed immediately by the owner of the livestock or an agent or employee of the owner; or

(b) the owner of the dog, when reasonably notified after due process, shall kill the dog within 24 hours of notification. If the owner fails to do so, an officer may be notified and shall kill the dog or cause the dog to be killed.

(3) A dog may not be killed in a manner that will endanger a person.

(4) This section does not apply to a dog herding livestock under the direction of its owner or the agents or employees of its owner.

(5) This section does not apply to a dog engaged in legitimate sport hunting or predator control activities under the direction of its owner or the agents or employees of its owner.

(6) The owner of a dog that harasses, kills, wounds, or injures livestock is guilty of a misdemeanor and upon conviction shall be fined not more than $500.

Post #4 is very disturbing.  Seems roaming dogs are allowed in PA and you are not allowed to do a thing about them.  Your best bet is to fence your yard, even if you just do it with hot wire.  If they hit that once or twice, they won't be back.  Glad I dont live there.


this is the law in PA

§ 459-501. Killing dogs; dogs as nuisances

(a) Legal to kill certain dogs.--Any person may kill any dog which he sees in the act of pursuing or wounding or killing any domestic animal, wounding or killing other dogs, cats or household pets, or pursuing, wounding or attacking human beings, whether or not such a dog bears the license tag required by the provisions of this act. There shall be no liability on such persons in damages or otherwise for such killing.

(b) Private nuisance.--Any dog that enters any field or enclosure where domestic animals are confined, provided that the enclosure is adequate for the purpose intended, shall constitute a private nuisance, and the owner or tenant of such field, or their agent or servant, may detain such dog and turn it over to the local police authority or State dog warden or employee of the department. While so detained, the dog shall be treated in a humane manner.

(c) Licensed dogs not included.--Licensed dogs, when accompanied by their owner or handler, shall not be included under the provisions of this section unless caught in the act of pursuing, wounding or killing any domestic animal, wounding or killing any dogs, cats or household pets, or pursuing, wounding or attacking human beings.

(d) Repealed. 1990, May 31, P.L. 213, No. 46, effective in 60 days.

Please don't shoot a dog... Please please... I understand that this dog is killing YOUR chickens and on your property, but there are definitely alternatives. It's not the dogs fault they have a bad owners... And rather careless at that. Try catching them. Lure them into a crate with food and then deliver them to a no-kill shelter, this owner sounds careless, they probably won't even bother looking for them, in which case these dogs could get a quality home.

Those dogs look just like mine... I can't even imagine shooting them. I know U sound pathetic, but please, don't kill them.

You need to review the rules of this section of the forum, please. Predators & Pests is not the place to judge those actions, which are entirely justified in any situation of a predator killing livestock, by the laws of most states and/or counties.

My black copper marans were killed to the last bird by a marauding pitbull the neighbor has treated like crap. My girls had just started laying again and here comes this dog, who has been over in the past, and kills the rooster first then the hens, one by one. The neighbors came by just as my wife grabbed the dog and the dumb *** woman let the dog go back to the people. I plan on catching that dog and killing him by beating him with an axe handle. I am going to start at the tail and crush his body to a pulp. He was let on our place and he was a good dog, never chased the chickens, and was always friendly. Again, the neighbors kept him chained to a tree all day and night because the man couldnt stand his dog liking us more than himself. So we let the dog come in and eat with our dogs and took care of him as best we could. Then he betrayed me and my girls so he is going to die, terribly. In kansas you can shoot any animal on your property. But I do not plan on shooting him. Maybe burning at the stake, some way he is going out howling. I hate feral animals, especially dogs. They just kill to kill. My two dogs didnt protect my girls, probably because we never trined them to gaurd against other dogs. Just trained them to defend against all wild predators. They are in the doghouse so to speak, but I am so upset about my girls. The Rooster went out to meet the dog as he came for them and defended his girls to the death, then the **** dog ran after and killed the 4 girls. just killed them without eating a tiny bit of them. oh i am so sad. My poor girls!!!!!!
 
Only one lazy cop would suggest you shoot the dogs unless absolutely necessary. If the copper was on the ball, he'd pay the irresponsible neighbor a visit. People like their money. If fines were imposed on this irresponsible owner, those dogs would likely stay on his property. What annoys me most are the irresponsible dog owners who suffer no consequences while the dog is shot or put down. Just like kids, some people shouldn't be allowed to breed much less own a dog.
 
I figure you have the right to do whatever you think you should do with a dog on your property...So it's really up to you. But it can cause issues with your neighbors, and often times you are stuck with the neighbors that you have...

The issue might be that there are simply no actual laws that the irresponsible neighbor is breaking.. no leash laws means the dogs can roam. The cop, at most, would only be able to warn him that there have been complaints and perhaps educate him that there are laws that if the dogs look like they might be threatening livestock or chickens.. they can be legally shot.
