should I kill this fox?

If it were me, I would concentrate on repairing and improving the pens if possible. you can kill the fox, but that does little to prevent further tragedies. Predators are an ever constant threat - and only a secure pen (IMO) can really solve your problems and prevent future losses.
 
yes, I would have to say I think my chicken pens are pretty safe, I think something would really have a tough time getting in if it did get in at all, but Paul was a wild man who would never go into the coops at night, instead he preferred sleeping in the trees, something I am not going to allow any more of our chickens to do. I am not locking up for the night till every one has been accounted for. Last night I had to go to church, so what I did was leave a radio playing to trick the fox and give the roosters time to get in before I got home to lock them up. They are all safe this morning. I am not planning on using the radio all the time, but we are putting a fence around the property as well as another one around the chicken pens, just to give another layer of protection. The fox has randomly shown up in the day time, which from what I understand is not normal. I know he is just doing what is natural to him, but he needs to do it somewhere else besides my flock.

If he comes back, I will attempt to shoot him, (my plan atm anyway)
 
I often see foxes in the day time, but be careful. In NC this year I know of two people who were actually attacked on their decks while they sat there by a rabid fox. They definitely should keep their distance if they see you. So far two have been killed next door to me, both eat up with mange and sickly looking. It has been a hard year on people and animals, with this heat.Foxes can jump rather high when they try. I like the idea of the double fence.
