Unless Monsanto can control the wind and which way it blows and when they can prove damage any lawsuit on either side should be tossed out.
I agree but they have successfully sued and farmer's have settled with Monsanto which put them out of business and/or in debt. They have been very aggressive in protecting their patents. One farmer did fight back and although "the judge agreed that a farmer can generally claim ownership of crops growing in his fields when they're inadvertently carried there by pollen or wind, this does not hold true when it comes to patented, genetically modified seed." It also looks like California did not win the vote to label genetically modified food.

That is a big loss for the entire country. We needed one state to set precedence for the rest of use.
 
Courts have held that wind an rain driven waste an sprays are the fault of the property owner that let it leave there property. Same thing. Monsanto uses green houses though. Its a farmer thing not a monsanto thing.
The ruling most likely will not last once GMO seeds are the norm in the environment. The DEA used to convict people by showing cocaine residue on $100.00 bills in the accused's possession but they soon proved that almost all the bills have some cocaine residuals on them. I wonder how many Monsanto suits were actually litigated or went to trial?

I just listened to a really neat podcast about how lard went from staple cooking item to 'no way am I gonna eat that'. Not surprisingly, advertising seems to have killed lard rather than health concerns. At any rate, I bring it up because the company making Crisco used some fairly aggressive advertising techniques for the time period. One thing they did was send out Crisco samples to hospitals and schools, then proclaim that Crisco is what schools and hospitals serve.

This unfortunately goes well beyond that, but thought you might be interested in looking it up Mom's Folly.
