I agree but they have successfully sued and farmer's have settled with Monsanto which put them out of business and/or in debt. They have been very aggressive in protecting their patents. One farmer did fight back and although "the judge agreed that a farmer can generally claim ownership of crops growing in his fields when they're inadvertently carried there by pollen or wind, this does not hold true when it comes to patented, genetically modified seed." See the below article.Unless Monsanto can control the wind and which way it blows and when they can prove damage any lawsuit on either side should be tossed out.
Actually he WOULD have to put those plants there, since a cross pollinated plant would only have the genes in the SEED:
"I never put those plants on my land. The question is, where do Monsanto's rights end and mine begin?"
The ruling most likely will not last once GMO seeds are the norm in the environment. The DEA used to convict people by showing cocaine residue on $100.00 bills in the accused's possession but they soon proved that almost all the bills have some cocaine residuals on them.
