Stolen Horse--Man is BACK in jail!

i haven't read all the replies but many of them. i have read alot of ur post and still check in to see how u and ur horse r doing as much as i can. i'm sorry u and max r haveing to go through all this been praying things work out for u guys and he is home asap.

to be honest with u if she recused herself for that reason the judge is a good judge and honest, she did it because it was a conflict of intrest. u don't find honest judges like that now a days it is nice to know there is still some good ones out there still. she did what she did in the intrest of justice and what was best for u and max to keep it from being a problem later that very well could hurt the case for u if she had not. since she excused herself it will go onto another judge were there is no conflict so the defendants can't use it to get the case dropped or use the conflict to cause probs later for u. it may not be what u wanted and i know how hard it must be, but keep ur chin up and don't give up.

if the new stations won't do anything the newspaper should but i don't reccommend doing that till they r sentanced and it is settled in court because it could cause more problems for the case or they may decide to counter sue depending on what is printed. if u do i'd be very careful and consult ur attorney first before makeing any statements to any kind of press so it doesn't accidently backfire on u.
best of luck,
silkie

I highly doubt its honesty here.....if so, she would have done so IMMEDIATELY as soon as she saw the veterinarian's name....which she would have seen on his statement...why did she wait so long I wonder.......

any new updates???

Praying for Max's safe Return! and Soon!

Okay, just a quick question... the judge backed out because she's related (in some way that wasn't super obvious immediately) to one vet that made one statement?

My question is this... is there ANY judge in the whole city/county? who isn't related to someone involved? You've got the vet, the old judge, the new one, the attorneys, the clients, the police who investigated, the owners of any land where the horse has been ever, anyone who loaned anyone a trailer... etc. This doesn't sound like a big bustling area, so I find it hard to believe that you're going to find a judge that doesn't know, is related to, or has done business with anyone involved. Unless they import a judge from Siberia...

Oh, and how many judges do they even have in this area? Does one judge handle everything, or are they split... Criminal, Civil, Divorce... so on. If split can the Divorce judge handle a Criminal case?

And it's going to chap if these delays are used to beef up the 'time we've had him vs time owner had him' argument...

I haven't read all of the postings. Have you a Brand inspection section in OK? Call them. Contact the state livestock board.
Forget the media unless it is a completely terrible situation they don't care.
Don't bother writing to your reps CALL them and keep calling. If you have a good one like me they will get some wheels turning.
Get pressure coming from different areas. Is your horse a registerd quarter horse? If so call the AQHA, they get pretty touchy about horses being mistreated.
Go to other ag web sites and get the word out. go to cattletoday.com/forum I belong there too. Lots of southern folks on it, they get pretty mad over horse thief. They might come up with some ideas too.

If I think of anything else I will post it.

OK has no brand inspector or brand inspector regulations. That's why the cattle and horse thieves take the stolen property there to sell. I think Kansas is the same way. In Nebraska, the brand inspector could step in and just make a decision on it. Nobody can ever question my ownership of my Haflinger in Nebraska because I bought her from the brand inspector.

FINALLY got a call today.

The judge recused (we already knew this) so we have to go throughout the entire hearing again because there was no one taking notes (you know, the one that sits there and types?). So...that'll be fun. I get to go through the whole ordeal again with a separate judge.

The new ownership hearing is set for Feb. 8 at 9AM. OH. And get this.

I was told that I would not need to be at the follow-up preliminary hearing that was set for January 20. Guess what? I've been subpoeneaed for that.
