I'm a little tired here after reading all of this and to tell you the truth I skimed over some of it but may I ask you a question. Do you know where this man lives that has your horse? Does he have a nice place? I'm only asking this because I would gladly give his son a horse if he would agree to give you your back. He would need to come and pick it up. AND I would need to know he's going to a good home. Or do you think this is a bad idea. I had a thread on the, everything else for sale. He's a 4 year old. But I don't want him to go to a bad home. And like I said I didn't read everything here so if I'm out of line please let me know. If you think that's a bad idea please let me know.

Bad idea. Very thoughtful of you to think of the child but I don't think there was much truth in that story. It was just a ploy for the man to get sympathy points and I don't think the court fell for it.
"According to the uncle at the ownership hearing, the jerk sold my horse to another woman as a roping horse. She paid $3,000. She was given a two week contract that said she could bring the horse back. LUCKILY she brought the horse back in that time frame. Oh. This happened in mid-February. The woman was in MO. Which means, MY horse left the state without a current Coggins. Nice"
If you read this post by Ropo you know it was totally a ploy to get the judges sympathy. If the child is so attached to the horse why was the uncle willing to sell the horse in the past? Yeah, the story about the broken hearted kid is bogus.

It's a sweet gesture, but don't fall for their stories. I don't believe it for a second, especially since they did not show sadness at the hearing, only anger, ESPECIALLY trying to get me to pay for all of their treatment and "heartbreak" their grandson was going to go through.
I have no idea where Max is in that area...the uncle "says" he's been taking care of Max and has vet records to prove it, but I have no idea if they have a barn or if max is on a bare feed lot with no shelter.
There are several horses on Craigslist right now for that area that are "bombproof" so I don't think they're going to be hurting trying to find him another one, hopefully THIS one they will get legally.

But it was a sweet gesture on your part.
Ok, thanks I see what you mean. I just want to try and help you out. Good luck and I'll be waiting to see when you get him back.
I thought it was the original lessee who sold Max to someone as a roping horse, not the uncle. And he apparently did it right away, if it was in February, so he had no intention of living up to the terms of the lease. The lady who "bought" him is just lucky she got her $3000 back, and that he still had it to return to her. He doesn't seem to hold on to anything very long.
As for the heartbreak of the 7 year-old, I thought at one point they claimed that no one could ride Max because he bucked.
Obviously, they are making it up as they go along, and I'm also worrying that Max has shelter and sufficient food right now. I can't see why all this delay, anyway, but you should take him as soon as the hearing is over. Bring a trailer and take a deputy with you, or at least your dad and brothers and any other large males you can round up for support!
You are a very patient and "together" person for one so young. I am WAAAAY older than you, and doubt that I could have handled it so well.
Thank you guys! In all honesty, I am not a patient person...I'm jumpy and nervous all the time right now. Until this is over at least. Hopefully then my "calm" will return.
Yes, the original lessee was the one who sold Max to the woman in Missouri. The uncle knew about this, asked the man where he had gotten the horse and THAT'S when the man told the uncle that I was his wife and had given him the horse...Needless to say, the uncle didn't ask any questions. Questions that should have been asked by an honest person.
EXACTLY. That will also be addressed at the preliminary hearing. If Max was so awful, how come he's being used as a child's horse? Why did he also allow his non-son to ride him all the way across the highway to the convenience store. He's got ALOT to answer for...
Unfortunately, the judge won't allow me to get the horse immediately, there has to be a time and/or date set for me to get Max. Already discussed that with the DA.
Can you do all of us "Aunties" a favor?? We already love Max and have been cheering you on through these last terrible months. We have a terrific interest in him. When you get him back, could you post a new picture of your beautiful boy for us to see? We want to know how this person treated him. Don't worry if he's not cleaned and shined up.
I hope it doesn't take long after to hearing to get him.
