Stolen Horse--Man is BACK in jail!

I'm not sure about the DA serving as attorney.

Hasn't it been the DA's responsibility to make sure the judge in the last hearing had everything she needed to proceed and then the uncle stating in court that he wasn't made aware the ownership hearing was also going to take place today. Wasn't it the DA office's responsibility to mail a legal notice or phone call?

Sounds to me that the DA's office has been droping the ball.

Can anyone with legal expertise let us know what the process is or should have been in notifying the uncle of the ownership hearing today?

Woo you may not have max back RIGHT NOW but this certainly sounds a lot better than how things have been going. Honestly. I went from uncertainty to hopes that are SOARING and strong feelings that prayers may just be answered

Sorry they postponed it again, though I'm not all that surprised to hear they did... Good luck at the next date anyway, maybe the judge will finally get her head out of her

The $2750 was determined by my lawyer fees (demand letter) and the back payments for the lease. The fines are being paid to the DA, court fees, time, etc.

He was charged with embezzlement. If he doesn't pay just one month...he goes to jail for pretty much any amount of time between 30 days and 5 years.

No...none of my family was there. My boyfriend wanted to come, but had finals. I've kind of given up on my family coming with me to the hearings. The one time my dad came was when he was already on medical leave.

I'm feeling a bit more optimistic this time around...the judge is obviously ticked, the DA offered to help me by representing me...it's starting to look at least a little brighter. I asked them if they could move the date up (they were gonna do another 3 weeks) and apparently the judge told the DA that she would but wasn't sure if it was enough notice.
 
It think it depends upon their schedule.
When I went to small claims the other guy called the Judge and claimed not enough notice.
She gave him a week. He never showed.
The way it was servered is the Deputy took the court papers to him and handed them to him.
Sorry I cannot recall what I had to pay for that but i got that included in the judgement.

I think it is a delay planned by the uncle and his lawyer.
Too bad there are not enough people supporting you there to keep an eye on the uncle to make sure he doesn't move Max elsewhere.

Sorry if I am coming across rather blunt. Just keep your eyes and ears open.

Although very frustrating this does feel much more positive. Hang in there and just hope that there are no more delays next time. We are all behind you and will help you to keep positive.
