I agree with you, Ropo. Best to put the whole mess behind you and enjoy your horse. Have you gotten up on his back yet?
I think all you could go after would be the nephew for unpaid lease payments while they had the horse for a year. Since the nephew seems to be pretty much a loser with no assets, you probably would be in for another long, ugly court fight, and possibly wind up with nothing anyway. Write it off to experience.
I understand how an earlier poster feels---we checked in here daily for updates. Now it's kind of suddenly over! We are thrilled for you, of course, but the DRAMA is over!
Your patience and persistence is what brought you through, and I wish you all the best in life. Many folks much older and more worldly-wise could not have handled it so well.
Nope, I haven't been on his back yet, I want the farrier to look at his feet before I get up and put more stress on the hooves. It's a precaution, but I'd like to be safe rather than feel sorry after it's already too late.
The nephew is paying back lease payments as according to the plea deal he took.
but I agree with you. You've had so much stress over the last year with this mess, and you've been SOOOO lucky to finally have an outcome that's frankly better than many here expected. Max is back, safe and mostly sound. While you might have the legal and moral right to go after punitive damages, none of what you might gain (if you were even more lucky) would be better than what you've already got, and the stress involved in the process would probably rob you of much of the joy you have right now. The bad guys will bring their own pile of *^%$ down on their own heads without your help - seems like they've been doing a good job of it so far. Enjoy Max, your victory over the bad guys and all the other good things in your life, and put this behind you.
And please, give him a skritch around the ears from me?

It has been like a suspense novel to read this, but I'm sure, Ropo, that you are ready for "boring" for awhile! Max is a lucky horse!
I know...I sit back and think "what's next?"
Nothing is EVER simple in the Rodriguez clan. Everything winds up being a big ordeal or adventure.
As for the civil suit, I just want those people in jail and forget them. I can't take any more stress in my life. I've made enemies in that town and never want to return to it.
After looking closer at the hooves, it's not to the hairline. There's at least a 1/2" of good hoof between the hairline and top of the crack. I called the farrier, but never got a return call. I'll be trying to call sometime tomorrow? If he doesn't call back, I'm moving on to a different farrier. Surely one of them will want my business.
Ropo, in a civil suit, you hire an attorney, and let them worry with everything. They call you to testify about the facts. You might have to sit in the trial. A civil suit trial on this matter should take about an hour. You enter the transcripts of the criminal trials and hearings and the judge, hopefully same judge, rules in your favor. Probally would not go with a jury. Might get all those enemies on the jury.
Wow - I was away on holiday for a week and came back on to find this wonderful outcome - I have followed all through this and I am so pleased to see you and Max reunited!! May I wish both of you a happy rest of life together and well done for keeping at this and not giving up
I just wanted to post and say congratulations to you! I can not believe everything that you had to go through to get your horse back. You are a very strong and patient woman. Enjoy your horse!!
