We were invited on the Judge Judy show once. Both parties have to agree to be on the show, but the case still might not be selected. We ended up not going and doing regular small claims. It was a horse case too. The lady owed me board money. The staff of the show scours small claims case filings and selects a few. When you appear on the show, the losing party doesn't actually pay. The show has a pool of money that it uses to cover judgements. The show pays travel and hotel expenses for participants and gives them a stipend for meals, etc. If you are suing somebody for $4000, there is a $4000 fund established. If Judge Judy awards you $3000, you get the $3000 and the balance of $1000 is split between the two parties. She does sometimes order people to return property, but I don't know how effective that is. I did hear her say on one episode that she would "send the marshals over to collect it" if the person didn't produce it. It's anybody's guess if she could or not.

If that's how the show works I wouldn't do it. Shouldve figured it was just for ratings - doesn't sound like it'd actually be of any help unless you want money, which isn't the case...

Unfortunately, because there was an agreement in place, authorities will treat it as CIVIL and there is nothing they can legally do.

I think you have two options.

1) Since you live in Oklahoma, you might have protection through the brand inspectors. Because the horse was SOLD it is very possible that the brand inspector could help you reclaim the horse without going through court, but I'm not sure of the exact laws or their authority.

2) Contact an attorney and see about filing a law suit or at least an injunction. If you know his location, you need to prohibit the uncle from being able to legally sell him before you can get this sorted out.
Please realize that our mission is to FIND stolen/missing horses, whereas, it sounds as if you know your horse's location. We cannot do anything legally to help get the horse back. Normally, in these situations, we work to find the horse then that person has a better chance of receiving ownership of the horse in a court of law.

In essence, they can't help. I have repeatedly tried to put information up on their website using IE and Firefox yet still get a "Forbidden" page.​
 
For everyone's information...yeah, I have been keeping up with the thread. Sheriff bailed.. Deputies bailed. Ranger bailed. Lawyer quit and never gave her a referral, like he promised... Can't file as stolen. Can't figure out who to sue. Dunno if it should be civil or criminal -- or both. Media doesn't care. NetPosse says it's a civil case.. I get it -- it's FUBAR. I'm paying attention.

Still, I could never figure out why she couldn't just go get the freaking horse. I know she was concerned that the guy might try to do something stupid, but I never saw anything concrete in terms of threats until.....

Who called who here....did he call the Sheriff, or did the Sheriff call him? Did the Sheriff warn you that the guy threatened to "protect what's his" if you showed up? Did the Sheriff advise you NOT to go collect your horse?

I know all the deputies refused to go because there was nothing brewing in court, but...wouldn't they HAVE to come if there was a dispute? Then they're coming for a dispute -- not to get a horse back, necessarily. I mean, yeah, he could shoot you dead but what if you simply called the sheriff ahead of time and said "Since nobody will help me, I'm going to get my horse back RIGHT NOW. By myself. I'm pretty sure this guy's gonna kill me, so you might want to send a deputy or two unless you want blood on your hands." Give him the address, and THEN HANG THE PHONE UP.

They won't have much choice but to get involved then, now will they? Stop short of the guy's place and wait for cruisers. If they don't show, don't go. When you see them in the rear-view, boogie on in before they can stop you.

Then you're there with a trailer and deputies. That's about a 1000% improvement from where you're at now.

Maybe that's not feasible...I don't know. Maybe you could just call the Sheriff, update him on the situation, and tell him you're down to doing that. See what he says. Maybe that'll spur him into action..

The sheriff warned me that this man will protect what's his. The P.I. called him to get his statement.


The sheriff could ALWAYS say that since there has been no dispute as of yet he can't get involved. Plus, there's the fact of the matter that if I called, he would call the man who has my horse and when the sheriff/deputy does NOT show up, I leave because it's not safe and the man who has my horse moves my horse to another area where I will never find him.
 
This is outrageous! Can ANYONE read this and feel that the uncle has the right to keep that horse?? This is the "good old boy" network in full swing. I believe, after reading over everything you've tried, that the spotlight of media is what will finally bring this to a conclusion. When the sheriff, DA, Attorney General, ranger, investigator, whoever is being interviewed by "Five on your side" or whatever your local TV station is, he will be squirming when asked why he/they have refused to take action. This is so infuriating that for any reasonable person to sit there and say there is nothing to be done..................wow. Beyond belief. You can prove ownership. All you need is for the law to get your horse from him and give it back to you, and they won't do it. The injustice of it boggles the mind. I am just so sorry this happened, and all of us are pulling for you to get that beautiful horse back. I do, however, think you are smart not to go there yourself, however tempting it is. Stay safe. To any others who are thinking of leasing out a horse---read and take heed. Be careful.
 
Have you tried the state brand inspector. Around here they have a lot of sway. If there is disputed ownership of a horse or bovine, the brand inspector checks the papers (registration, vet records, contracts, bills of sales, photos, whatever) and determines who owns it. PERIOD!!!
