Stolen Horse--Man is BACK in jail!

Wow. Just got a call from the man who I leased my horse to.

Told me that he would pay for me to get another horse because he and his uncle's lawyer don't think I'm going to be getting my horse back. The uncle now has the horse priced at $7,000.


Yeah.




I told him no and that if he needed to contact me again that it would be with a police officer in tow.




****He changed his number again.****

He continues to claim that he couldn't get ahold of me. Interesting isn't it how he tried to bargain, then tried to threaten me by saying that I'm not going to get my horse back. Nice. I am so ticked right now I could spit.

There's a special place in Hell for people like this.

He is definitely gelded. I do not want to contribute to the overpopulation, plus...he's just not stud material.

I called OHP to see if they could help at all.


They don't have jurisdiction in county, but are seeing "what the heck those boys are doing down there."

Out of curiousity, why would they think that they are keeping this horse?

If they went to court, what would they possibly say to prove that the horse is rightfully theirs? I am just trying to figure out how "they" view this issue.

I highly doubt that is was a rescue, because anyone that "rescued" a starving horse wouldn't "sell" it back to the home it came from... I think that in itself is proof, that they didn't "rescue" this horse out of the kindness of their heart.

Please make sure that who have MULTIPLE documentation that you are attempting to reclaim this horse! You don't want it to accidently let it qualify as "abandonment". I know here, if you care for the animal for so many months, after a certain period of time, it is yours through abandonment.

I still stick with my original thought that you need to file a case in small claims court, and serve them with papers by a professional server. If they flake and don't show in court, which I DOUBT they would, you would win by default. Make your claim as high as possible to the limit of small claims court, and if your state has a limit that is too low for you, file a different suit against each individual separately, separate case numbers... That doubles your chances for award $. Once you have a judgement, you can go get your horses and they have not a leg to stand on. You could even ask the judge to order them to RETURN THE HORSE TO YOU in the same condition as it was taken, i.e. shod or not, up to date on shots and worming, reasonable weight. I forget what it is called, a non-monetary consideration or something like that.
