Don't have him back yet, but we are WELL on the way now!

This is certainly a step in the right direction!!! Hopefully now the uncle will do the right thing and turn the horse over to you!!

check your local regulations, here is Pa I know you can just call the department and request an officer be present, no paperwork needed just proof of ownership.

Unfortunately I have already tried calling the sheriff's office to see if they will allow a deputy to come with me. It was a no-go. They said I had to have a document signed by a judge to have a deputy come out there.

Was that before they filed charges and arrested him tho? Maybe it's different now.

No, it's still the same. Straight from the OHP who was finally able to get someone to call him back. The deputy who took my original report was the one who called him back and said that they had to have a civil stand-by signed in order to go out there.

But, no harm in calling tomorrow after I talk to the DA!

That's a Constitutional Law issue. The presence of the officer at a repossession not covered by a court order can be construed as "under color of law" and as a violation of due process.

OTOH, you are probably covered under "self help" if you or your agent go and get the horse as long as there's no breach of peace. If you do this, let the police know when and where you are performing the repossession before you go.

I've been quietly following along for a long time now & since his name is finally public, here's a public records link which shows the numerous times this young man has been in trouble with the law.

Sorry about that ... didn't realize it was wrong to put the guy's name in there, since the news article is public. I apologize.

Quite a record for a 22 year old.

Great source though. OP should use it in the future before leasing the horse to another.

Although I must say, RP you should have broke your contract the moment he violated it especially the second and third time.
