I think actually if they had probable cause they can enter the premises and the house. Like maybe the neighbor reported you. Maybe when they came to your house they could hear the chickens? Better find out before jumping the gun.

Start filing complaints, calling newspapers and DO NOT LET UP. They should have given you a ticket or a citation of some sort. There should have been on this the specific law you are violating and you would have had a chance to go to court. Something is REALLY fishy here.

they are not above the law!! they can not break in your home with out cause. what 4 chickens was cause...no felony!! i would call his supervisor and ask if it is legal to enter a house with out a warrant, ask what his probical cause was? ask why weren't you given warning or cited first. ASK QUESTIONS. sounds like an inside job and like i said, they are not above the law!

This is called illegal search and seizure. No police officer can enter your home without your consent unless he has a warrant issued by a judge. Without that piece of paper, YOU can press charges against HIM! You should do just that. If citizens do not press charges against illegal police actions, the whole system of checks and balances that protect our rights will slowly erode until we have no rights except the ones the police decide to give us.

Maybe for cock fighting but not a civil matter. This is no felony and they have to cite you first! You are intitled to your day in court. then if you loose they can come and take them IF you don't relocate them!!

How would you feel if a cop came in your house when you weren't home cause he claims he saw stolen good or heard your dog bark more than once. WARRANTS serve a purpose, they gather evidence. is she being brought up on charges??? NO, so what they did is illegal.

I'm not a lawyer ... but ...

In most jurisdictions, the police cannot enter without a warrant, unless there is an indication that a felony is in progress, or evidence that someone within is in danger. There *may* be an ordinance allowing animal control to enter, but again, there would have to be evidence that the animal within was presenting an immediate danger, or was presently being abused. If not, they'd need a warrant too. I doubt that "hearing illegal chickens" is a sufficiently dangerous crime to justify entering a closed dwelling without a warrant. Send the ACLU after them!

On the other hand, your state elected a pro wrestler as your governor, and sent a comedian to congress, so all bets are off.
