The details vary by state, but if your neighbor's fence is on your yard and you do nothing about it, after a period of time (can be as little as 5 years!) they can claim title of that portion of your property by adverse possession, or claim a proscriptive easement, entitlling them the RIGHT to use the land. Get the survey done NOW, and if it is indeed on your land, address the issue now. Doesn't mean you have to build a fence now, but do take steps to prevent them from obtaining your land.

franklinstreetwest,

Get a survey done, if it is on your property tell her to tear it down otherwise you will and further you will send her a bill for having it removed, and if she doesn't want to pay that bill you will place a lien on her property.

Otherwise as Sonoran has mentioned in some states you can lose title to a portion of your land.

Not in some states. In ALL states. However, the timeframe and other particulars that determine when adverse possession or a proscriptive easement occurs vary from one state to another. However, allowing one to build a fence on your property, essentially fencing you out is a HUGE step into acquiring title to that portion of the property, and more likely by adverse possession (as it restricts your use of the property) than by easement, which would be if he regularly used your land as a driveway to his own, but not preventing you or others from also using it.

ISTR that in several states adverse possession laws have been severely limited. It has been several years since I have done any in depth research into them.
