Any legal advice out there??

1. If the dogs were neutered would it keep them from being aggressive when a female is in heat?
2. Is it illegal to take someone elses dog and have it fixed without their consent if its running at large?
3. Should she contact law enforcement on the issue and what exactly would she be filing?
4. Is there anything she can try to maybe get the males to not be so aggressive during the time of the heat cycles?

1. It depends on how long they have been intact and has it become behavorial.

2. Yes. Because then you are giving the pretense that it is your dog and if something happens under anesthesia you would be held liable.

3. I would contact her law enforcement. But the laws are different everywhere. I live in Louisiana and where I live they can roam free but if they destroy property they can be picked up.

4. Not that I am aware of

BTW I am a veterinary technician in Louisiana.

I have read a few threads regarding unwanted strays etc. and the often made comment is "I shouldn't have to fence my property...". While I agree wholeheartedly that you should not have to go to the expense of altering your property the bottom line is that ignorant people as well as bullies and those who plain don't respect anybody else or the law, will always exist. Once these dogs are gone there will soon be other male dogs attracted to the females in heat. Secure fencing doesn't have to be hugelyl expensive and it solves the problems.

Also, don't be so sure that those dogs are watching the goats deliver their kids because they want to be friends! They are young, intact, male dogs roaming loose, already showing they can be aggressive. It's a short step to killing other livestock.

Rotten situation, rotten neighbor. I hope she is able to get some help and get it resolved. I still say go for better fencing.

Definitely show the deputy when he/she comes out. If the man denies ownership, the deputy can have the dogs impounded. Even if the pounds are full, law enforcement can usually have them make room for another. I know you may feel bad for the dogs because they might be put to sleep, but there are too many nice dogs looking for homes to spend too much time with aggressive ones.
 
I recommend just dropping them off at an animal shelter as strays if their owner doesn't take care of them correctly
 
Well the sheriff came out, watched the video, talked to the neighbor and told him that if he had to come out again over the dogs trespassing that not only will be fined for it but he may have to spend time in jail because the breed is on the "dangerous dog list" and he suggested to my MIL that she keep a pistol handy and if the dogs so much as think about stepping onto her property to shoot them because they have "attempted to attack" a human. She now has some kind of papers that make it legal for her to shoot(and kill) them. The sheriff apologized because there wasn't much else he could do. He has no one to call to pick them up and they were friendly when he was present so he couldn't shoot them. If anything suspicious happens to her animals the neighbor was also warned that he will be held responsible. Which I thought was weird but maybe it was just to scare him. The sheriff also made him walk to her house to pick up the dogs on leashes and take them inside his house! So now at least they are documented and if it happens again she can't get into any trouble for killing them.

Also the sheriff told her (privately) to shoot the dog in the head then run over it to make it look like it was killed by a car rather than shot. That was to keep the neighbor from retaliating.
 
holy the law is on the good side batman ! Told her if she had to shoot, run over it before calling him. I cant help but chuckle.
 
Wow! I feel for you MIL. I hear there is a type of bullet that can be used with a hand gun that sprays like a shot gun. I think that is what I'd have in my gun because I'm afraid I'd not be a very good shot and wouldn't be able to get another one off in time, if the situation went south.
