bought eggs but seller hasn't shipped yet! NEW UPDATE!

She has not responded to my last message through Paypal from the 15th. I'm not sure how long to wait until I escalate the dispute to a claim. You'd think she would check on it everyday. All my responses to her were within hours of her sending it. Definitely going to leave negative feedback. This is just ridiculous.

Just escalate now. If she can't show through Delivery Confirmation that those eggs were delivered to your address (which she has if you paid through Paypal, assuming that your address is correct on your PP account), Paypal is going to side with you. I think she is just stalling, hoping that you will give her the benefit of the doubt and drop your claim. You don't want the eggs now anyhow, so there's no point in letting this drag on.
 
On 10/15 I finally get a response:
"I recieved box back today, Please send me your address, box said undeliverable no such address. These eggs will not hatch now thats for sure. I will pick and send you 12 fresh eggs today. Please send address ASAP. Thanks"

Guaranteed she did not send the eggs, just trying to buy more time.

I looked on my Paypal receipt and it does not have my address listed and neither does Ovabid. So there is no way she even has my address to even attempt to send the eggs. She would have had to email me and ask for it, which she never did. So that 'returned box' is an outright lie. So this is what I wrote to her just now.

Okay look, I've been patient but my patience is running thin. You've made me wait an unreasonable amount of time for eggs without any kind of communication until I reported it to Paypal. Now you are dragging your feet returning my money. This is only going to lead to extremely negative feedback for you. You have until the end of business tomorrow, Monday October 18th, to refund my $33.00 or I will escalate this dispute to a claim AND leave negative feedback AND tell every chicken person I know about my experience with you. And I am curious, what address did you 'attempt' to send my eggs to? I don't know how you would have even gotten my address as you never attempted to communicate with me in order for me to give it to you.

Hopefully this will get her butt moving.

but I have to say my experience wth BYC made me the kind of seller I am. The pros taught me rights from wrongs before I even sold/sent an egg-I read ALOT before I even posted my first post...I owe it all to BYCer's LOVE YOU GUYS!!!!
 
I escalated it to a claim yesterday. I hope Paypal decides to give me my money back. They're waiting for her to respond. What if she doesn't respond to them? How long could this drag out? I know it's only $33, but still....
 
If she does not respond or can not verify that she sent you merchandise within I believe one week your money will get refunded, unless she selects refunding the money instead of disputing the transaction.
