Can't sell Quail,Pheasant, Turkeys and now ducks and geese in Florida?

Up here we sell everything and never has anyone wanted to enforce any laws at our auctions,THANK GOD!! We are self policing. Cause when you go to sell your birds they take your name and when you buy the birds they take your name and so... If you bring a bad ,sick or diseased bird. Everyone knows your name and then its called MUD

I feel your pain Blue though. If it helps you can plead ingnorance on having a permit. Heck its half true thats why people are confused now.

That works sometimes. They might give you a "mulligan"

THE STATUE SPECIFICALLY DOES SAY THAT IN ORDER TO EXHIBIT YOU NEED THE LICENCE IRREGUARDLESS OF STOCK NUMBERS/ COVEY SIZE. REMEMBER FWC HAS A SERIOUS HARDON FOR MALLARDS! WHILE THE FEDS STAY OUT OF MALLARDS(MALLARDS ARE THE ONLY MIGRATORY WAYERFOWL THE FEDS DONT CONTROL) AND LEAVE IT UP TO THE INDIVIDUAL STATES FWC ABSOLUTELY HATES THEM! YOU MUST HAVE GAME FARM LICENCE TO POSSESS EVEN 1, LET ALONE BREED OR OFFER FOR SALE , AS WELL AS SUPPOSED TO HAVE 1 FOR PURCHASE AS WELL. DESTIN IS CORRECT, THE MORE OFFICES YOU CALL THE MORE VARIED THE RESPONSES WILL BE--- THEY WANT YOUR MONEY BUT NO ONE ACTUALLY KNOWS FOR SURE HOW TO INTERPRET OF ENFORCE THE LAW. HOW CAN YOU OWN UP TO 50 FOR PERSONAL USE AND NOT BE ABLE TO BUY EVEN 1 WITHOUT A PERMIT???-- YOU CANT, SO THATS INCORRECT RIGHT THERE. IF YOUD LIKE PM ME AND I CAN GET YOU THE COINTACT INFO FOR THE "INVESTIGATOR IN MY AREA WHO ACTUALLY APPROVES/ INSPECTS/ AND ISSUES THE GFL IN THIS LOCATION... I WOULD THINK HE CAN ANSWER SPECIFIC QUESTIONS AS THAT AND INVESTIGATIONS ARE ALL HE DOES--- HE'S NOT A ROAD WARDEN, BUT RATHER A LT/ INVESTIGATOR-- THEIR IDEA OF DETECTIVE AS COMPARED TO CIVIL LAW ENFORCEMENT AGENCY STANDARDS

JJ, once again your wisdom and "been round the block a time or two" experience came in handy. I did go on the mission to study my Colo statutes after reading your replies.

I made the mistake of calling the Colo Div. of Wildlife....got transfered 4 times....then got HER. You know the type of officer or representative we were talking about in the beginning of this post. Probably green, if not, has an "I'm going to put you in your place for even asking me for information...I'm a CRIME FIGHTER" type. I used to avoid hiring these people for Animal Control when I was director. They tend to reach beyond the scope of their jobs and get the agency in trouble for misquoting law and using "excessive force" albiet verbal (all the more infuriating and embarassing to the agency). The Sherrif's Dept. used to bring an occasional one of my own team to my attention once in a while they were trying to "pull people over with the animal control truck". OH JOY, the EAGER BEAVER wielding power they do not have.....get the walking papers ready.

When I hung up with HER. My old dog self decided to do what I would do if I were in her position and study the law, compare it to the municpal and county, and then talk to the local guys and gals. She stated "You and I will be talking at length and you WILL GO THRU ME, NOT YOUR LOCAL OFFICE ON THIS" Red Flag!!!!!! I took care of myself. I read.

Looks as if Coturnix Quail here are lumped into a list of "unregulated wildlife". Included in the list as an example are the "common goldfish", iguanas, non poisonous frogs and toads, beta fish, psitticine birds such as parrots...you get the jist, pet store animals! Hellooooo Petco or Petsmart ring a bell? What do they sell? Are there daily raids on them?

That woman was soooo rude, accusatory and grilling with me. She said she would be sending people to see my currently 3.......THREE Coturnix. She asked where I was getting them from and how to spell it (Coturnix)

.
Hah ha he he. She really must have been invisioning some kind of monster.

I wanted to relate to those who were reading this post and becoming frustrated about laws, rules, regs. I wanted to tell you I have been on BOTH sides of the law re: Animals. We supervisors or Directors, used to despise or at least worry about our staff performing this way.

Dig for and read every thing you can on your state laws. Copy it or save it to your docs. Highlight all lines that refer to your species and keep an "Owners Manual" for yourself, your farm.

This is the entire reason I created the program I did for responsible pet ownership class for my County. People were slapped with a charge and not given resources to do the right thing. The officers were walking away with attitude and the animal owner with a broken heart, frustration, and anger!

I listen to people who have been "busted". I let them vent. I go over the law with them. I tell them how they can get out of this. I ask them to tell me about their experience. I tell them to make an owner's manual and give them a head start by giving them a copy of city and county law. HELP+ UNDERSTANDING +INFORMATION+KINDNESS = EDUCATION and a responsible animal keeper.

I was so frustrated and angry yesterday, and then I remembered why I do what I do.

I always tell my clients to make their "Owner's Manual" on their animals. Any accusations or charges ever thrown their way again. They whip out the ring binder or send the PDF file of the Laws that pertain or justify what they are doing with thier animals. Read it and weep officer OR in most cases NEIGHBOR with bad blood syndrome.

This is my attitude after about 18 years as a Dept. of Ag. investigator.
JJ you are right. Officers can be wrong. They can be a power and control type of personality. They are human . Research your laws folks so you can protect yourself from a fellow human given a shiny thing they wear on their shirt called a badge.
wink.png

Now where can I upload the Colorado Statute I found for my fellow buddies in Quail?

NOW for the serious ones. The ones JJ keeps, migratory, mallards, and native species that can be released for hunting etc. Those are the regulated ones. My advise is to read until your eyes hurt. Be smarter than those accusing.

Thanks for letting me rant just a bit.

I will go back in my hole and continue building my owners manual.

Man it gets your blood pressure going to be treated so.

At its website, the Florida Department of Agriculture states: "The selling and purchasing of game birds (quail, pheasants, etc.) require a permit from the Florida Fish and Wildlife Conservation Commission."

A paragraph at the Florida Fish and Wildlife Conservation Commission website was referenced in a post above. This paragraph is: F. GAME MAMMALS AND BIRDS. This paragraph states: "A license is not required for possession of Bison for commercial farming purposes, possession of 50 or fewer live bob white quail or non-native game birds (except non-native ducks and geese) possessed for personal use, consumption, educational, dog training OR OTHER NOT-FOR-SALE OR EXHIBITION PURPOSE, or possession of game bird eggs for consumption." When read through to its end, this sentence does not indicate that you can sell bobwhites or non-native gamebirds possessed for personal use without a license.

Thank you for noting those two points in the Florida wildlife laws. I am interested and will re-read Colorado re: keeping non native for egg consumption as well as the exhibition part. Seems if it is similar that is where I will have to procure a license ....if my child wants to show his quail at fair.

A great thread. A good study. Nice to read along with someone with experience.

Just wanted to throw in my 2 cents of website research

The exemption is only valid for PERSONAL use, from what I read on the thread BOTH personal and for sale were brought into question - sorry if this is a repeat but this is a direct quote off of the Florida FWC website.

(direct quote, as in they misspelled "quail" and I didn't spell check for them

Unfortunately, the penalties for violations can be severe and it would be unfortunate if someone acted on the wrong info and got into trouble. I think what Tonya said in one of her posts above makes a lot of sense: "Dig for and read every thing you can on your state laws. Copy it or save it to your docs. Highlight all lines that refer to your species and keep an "Owners Manual" for yourself, your farm."

YOUR GAMEWARDEN IS WRONG AND FWC NEEDS TO BE CALLED AND THE SITUATION REPORTED IMMEDIATELY!--- CALL THE LAKELAND REGIONAL OFFICE 863-648-3200 AS THAT IS MISSION CONTROL FOR THE ORGANIZATION,,, FL REQUIREMENTS FOR GAME BIRDS--- ALL QUAIL, INCLUDING BUTTONS/ ALL COTURNIX SPECES(JAPANESE, AFRICAN HARLEQUIN, RAIN, BUSH, ETC..)/ ALL NEW WORLD QUAIL SPECES- BOBS VALLEYS, GAMBELS, MOUNTAINS, MEARNES, ELEGANT, SCALED, MASKED/ ALL PHEASANT SPECES/ ALL PARTRIDGE SPECES/ ALL GROUSE SPECES/ LESSER OR GREATER PRAIRIE CHICKENS/ALL MIGRATORY WATERFOWL= YOU MAY POSSES(NOT SELL- THATS FEDERAL) ----- YOU ARE ALLOWED TO HAVE UP TO AN AGREGATE TOTAL OF 50 OF ANY AND ALL SPECES (EXCEPT MALLARD DUCKS) AND DO NOT NEED A LICENCE TO POSESS/ BREED/ OR SELL. MALLARDS REQUIRE A GAME FARM LICENCE TO EVEN POSESS, LET ALONE BREED OR SELL. SALE OF OTHER MIGRATORY WATERFOWL COMES UNDER THE AUSPICES OF US FISH AND WILDLIFE AND REQUIRES SEPERATE PERMITTING

ORDINARILY I WOULD TELL YOU TO LOOK IT UP FOR YOURSELF RATHER THAN TAKE THE WORD OF A STRANGER ON THE INTERNET, BUT I AM IN FLORIDA AND STATE AND FEDERALLY LICENCED AND VERY FAMILIAR WITH THE STATE AND FEDERAL REGS. ANYTHING OTHER THAN WHATS LISTED HERE FEEL FREE TO PM ME AS I MAY HAVE MISSED SOMETHING OBSCURE??? YOUR GAME WARDEN IS INCORRECT AND THIS NEEDS TO BE REPORTED ASAP SO IT CAN BE RECTIFIED AND THE INDIVIDUAL TRAINED OR RETRAINED AS APPROPRIATE. THE ONLY LOOP HOLE THE LAW CLEARLY STATES FOR PERSONAL USE AND DOES NOT EXEMPT EXHIBITION. IT ALSO DOES NOT STATE ANYTHING ABOUT 1/2 OF THE SPECES LISTED IN YOUR POST... DOMESTIC TURKEY BREEDS ARE NOT RESTRICTED AS WELL AS DOMESTIC WATERFOWL OR PEAFOWL. A PERMIT IS NOT NEEDED FOR SALE OR PURCHASE OF MOST SPECES UNLESS YOU POSESS OVER 50 IN AGGREGATE. HERE'S THE LINK... http://myfwc.com/RULESANDREGS/Rules_CaptiveCategories.htm#game THE SECTION YOU ARE LOOKING FOR IS "GAME MAMMALS AND BIRDS"

I'll take JMR's advice, he is fluent with FL state regulations.

Also do not bog down to any overzealous govnm workers, check them out and challenge them if you think the are full of it.

State of Fl is going bankrupt like most states, looking for new revenues and harrasing citizens 7/24/365

The last 2 "Republican" Governors Jeb Bush and Chris build up the state government and raised taxes MORE than any of previous democratic Governors. (Not that I am a democrat supporter).

Chris DOUBLED car licence fees, driver licence and other fees and taxes in a heartbeat. Thanks God this jerk lost last election.
