Yes, that is true, but you can't get punitive damages if you're not registered, only the costs and damages from the infringement. If you are registered, you can tack an extra $10,000 per infringement to each item, for example.

There are three benefits to registering a copyright. First, registration creates a public record of a copyright. Second, registration of a copyright is required in order to file a lawsuit for copyright infringement. Third, if a copyright is registered before there is an infringement or within three months after the first publication of a work, the owner of the copyright can claim certain alternate damages plus attorneyís fees. These alternate damages are called statutory damages and they can be awarded in a sum of up to $100,000 for willful infringements. The registration process itself, does not alter the fact that the owner of a copyright is always entitled to his or her actual damages plus any profits earned by the infringner. However, the suggestion that statutory damages and attorneyís fees are available can act as a catalyst for the quick settlement of a copyright infringement claim.

When was the work first published?

I've seen people try to get those punitive damages and totally lose because their works were not registered at the time that the infringement happened.

When I got my championship the picture we sent in was stolen. Years later the picture showed up in various mag's . The guy that took the photo had all the rights so I think he did something and years later the photo is still used. Its a beach photo with the horse jumping a little as the wave comes in. So i would let them know you own the photo and never gave anyone permission to use it. The least they should do is reprint. Since it is also local have you tried looking in the phone book ?

Yeah, and that's been a while. Even to go back to when the calendar was published, it's been more than three months, they put it out in October.

What's really funny is that I got the calendar last year, and skipped picking one up this year because I pretty much only use my BYC calendar!! LOL And the OR Dept of Ag is out of them, so I can't even get one now that my boy is in it!
