Mass Murder last night

I let my husband mediate. He said the guy said he was sorry it happened, he went into a story about one of the dogs having a really hard life and heartworm treatments. He Couldnt believe they had travelled two miles to get to our house.
And just agreed to talk with us again this week about what he owed us for our business.
I will let my husband call back this week and see if he is agreeable to payment or if his song has changed. I will post any new news.

I just read this whole thread and looked at your photos.

Agreed, sorry to say though. You did the right thing, you had no choice, but it's in a dogs instinct to do this.
I'm so sorry for your loss and hope that all comes right again in the end.

I'm so sorry for your loss. Sadly, I can relate to your pain as this coming December 3rd will be one year since a pack of wild dogs attacked and killed 5 of our goats. One female was due any day with twins. She somehow survived the attack, but they chewed her up pretty good so I had to put her down myself because she was suffering so. I did manage to kill all but two of the dogs, and a neighbor caught up with them later that day in the swamp near our homestead and he took care of them. I called the police, they made a report, but that's all they could do. Again, I'm so sorry.

My husband talked to the original guy we thought owned both dogs (the one whos dog had a tag on) again tonight for a while explaining details to him. The other dog belonged to his neighbor and he said this neighbor was a hot head and would not pay us and had actaully filed a complaint against us for killing his dog.
Something about a friend of theirs is a police officer and told them too. Obviously they have not read the Alabama law which my husband and I have both searched.

That said we still have not taked to them to confirm this since they will not talk to us on the phone nor call us back.

The original guy says he is willing to pay his half but not all of the amount. We will not accept any amount unless its in full and we explained to the guy that we will most likely see him in court for a much larger cost if this is his neighbors plan.

This is the part of ALABAMA law for ANIMAL ABUSE: (I highlighted #3 which pertains to us in the shall NOT APPLY TO as animal abusers)

This article shall not apply to any of the following persons or institutions:

(1) Academic and research enterprises that use dogs or cats for medical or pharmaceutical research or testing.
(2) Any owner of a dog or cat who euthanizes the dog or cat for humane purposes.
(3) Any person who kills a dog or cat found outside of the owned or rented property of the owner or custodian of the dog or cat when the dog or cat threatens immediate physical injury or is causing physical injury to any person, animal, bird, or silvicultural or agricultural industry.(4) A person who shoots a dog or cat with a BB gun not capable of inflicting serious injury when the dog or cat is defecating or urinating on the person's property.
(5) A person who uses a training device, anti-bark collar, or an invisible fence on his or her own dog or cat or with permission of the owner.

And this which was posted herre on the forum but I have researched it in full on line:

(Acts 1915, No. 185, p. 259; Code 1923, § 3221; Code 1940, T. 3, § 5.)

§ 3-1-6. Liability of owner, etc., for injuries to livestock, etc., caused by dog while off premises of owner, etc.

If any dog, not being at the time on the premises of the owner or person having charge thereof, shall kill or injure any livestock, the owner or person having such dog in charge shall be liable for damages sustained by the killing or maiming of any livestock and for the full costs of the action.

I will update again as I get News. Hopefully this will help others if (and when) it happens again.

I think you made an error when calculating your egg loss...

If each hen lays approx 250 eggs in a year, that is about 21 dozen eggs. 21 dozen times 2.50 is $52.50....not $625 per hen-I suspect your error came in multiplying the number of eggs x 2.50 instead of the number of DOZENS...personally, from what you went through, I would say charge him whatever you want, but since it looks like you will be suing in court, I would make sure you have the numbers correct so it doesnt look like you are trying to fleece him....

I want to echo the same sympathies over your loss... how horrible! I watched the video and they were SO sweet!

I think you're doing the right thing and going the right direction - best of luck to you and keep us posted!

I am sorry to hear about your chickens. Your plight is makeing me consider dogs in our coop-run design. Something to be learned from all of this.

When I was 11, I had a mutt (I loved that dog) who killed a down the street neighbors chicken. The neighbor contacted my dad, and my dad made me go down to the guys house and apologize and make arrangements to make the neighbor "whole" again. The neighbor decided that if I mowed his lawn twice he would feel "whole".

We started keeping the mutt on a chain. I will be darned if that mutt didnt get off of his chain, go straight back to the down the street neighbor and kill the rest of the chickens (4). Well, the neighbor WAS NOT happy. My dad made me kill the dog, and I mowed that mans lawn all summer long.
