My husband talked to the original guy we thought owned both dogs (the one whos dog had a tag on) again tonight for a while explaining details to him. The other dog belonged to his neighbor and he said this neighbor was a hot head and would not pay us and had actaully filed a complaint against us for killing his dog.
Something about a friend of theirs is a police officer and told them too. Obviously they have not read the Alabama law which my husband and I have both searched.
That said we still have not taked to them to confirm this since they will not talk to us on the phone nor call us back.
The original guy says he is willing to pay his half but not all of the amount. We will not accept any amount unless its in full and we explained to the guy that we will most likely see him in court for a much larger cost if this is his neighbors plan.
This is the part of ALABAMA law for ANIMAL ABUSE: (I highlighted #3 which pertains to us in the shall NOT APPLY TO as animal abusers)
This article shall not apply to any of the following persons or institutions:
(1) Academic and research enterprises that use dogs or cats for medical or pharmaceutical research or testing.
(2) Any owner of a dog or cat who euthanizes the dog or cat for humane purposes.
(3) Any person who kills a dog or cat found outside of the owned or rented property of the owner or custodian of the dog or cat when the dog or cat threatens immediate physical injury or is causing physical injury to any person, animal, bird, or silvicultural or agricultural industry.(4) A person who shoots a dog or cat with a BB gun not capable of inflicting serious injury when the dog or cat is defecating or urinating on the person's property.
(5) A person who uses a training device, anti-bark collar, or an invisible fence on his or her own dog or cat or with permission of the owner.

§ 3-1-6. Liability of owner, etc., for injuries to livestock, etc., caused by dog while off premises of owner, etc.
If any dog, not being at the time on the premises of the owner or person having charge thereof, shall kill or injure any livestock, the owner or person having such dog in charge shall be liable for damages sustained by the killing or maiming of any livestock and for the full costs of the action.
