I'm so happy that your neighbor is such a nice guy, and is giving you a chance to reach a happy resolution together. It's a good thing neither he nor you have a massive sense of entitlement that comes along with an obnoxious neighbor.

Saying "to heck with you, it's zoned for me to make your life miserable, why don't you move?" is shockingly callous, and everything that is wrong with the worst that America has to offer. It's why other countries think that we are appallingly rude and nasty.

HOWEVER, two neighbors working together, being sane, and socially responsible and courteous with each other, like you are doing, is everything that has to do with the BEST that America has to offer.

Thanks for classing up the place

Why is it that you can go into any neighborhood, city or country, and 9 out of 10 people have dogs, which will bark day and night, and no one complains, or makes it illegal to have them. And there is always a dog who gets loose, gets into your trash, kills your chickens and poops on your lawn. And what about the cats that run around loose, pooping in your flower beds and spraying urine on the outside of your house and having a cat fight outside your bedroom window in the middle of the night. I say to your neighbor, get some ear plugs and close your window.

have 100's of birds and some roost on the railing of my back porch which is 20 foot from my bedroom, i use a fan to muffle the sound of crowing.
My roo's crow in the middle of the night sometimes and it's usually because they can hear roos faintly in the distance ,if there are other folks with chickens your roo may be hearing them ,so mabe ya could put a radio in the coop and see if that covers up the other night noises.

I couldn't disagree with you more, renovationmom. I don't think it's ever okay to wake a neighbor on a regular basis. I suffer from bad neighbors who have ignored all requests to keep their animals quiet at 2, 3, 4, 5 am. I lay in bed writing that note I'm going to put on their door (that I never deliver) for hours after being woken up. Most people don't have air conditioning here in Denver and can't sleep with windows closed on a 90degree night. It's nothing but selfish inconsiderate behavior and I don't see how they justify it.

What if the sound keeping him up was her new born child with colic? Are you going to have the child removed or retaliate?

What about all the neighbors who have dogs and cats, if you were to start complaining about them, will the dogs and cats have to be removed? They should, according to your statement-or does it only apply to Roosters?

I live in the country. And I hear lots of sounds, day and night, Trains, tractors, trucks with loud exhaust, pulling trailers, screaming children ,and animals of all kinds(especially dogs and cats-consider how many of your neighbors have them).

I grew up in NYC. If I were to open a window at night, I would hear loud music, planes, a constant sound of buses and cars going by, sirens and barking dogs. City or country, there will be noise. An open window invites all the noise in.

And consider the sounds inside your own home, appliances,heating/cooling systems, tvs and snoring.
There are many sounds that can wake up or keep up a person at night. If you are sleeping well, you will sleep right through any of those sounds. If you are worried, or stressed, any sound will wake you up, and keep you up.

So, my point is, if a sound is bothering you, you need to do what you can to elimanate -without resorting to violence or having the cause of the sound removed-close your window, get a/c, use earplugs, get black out curtains, insulate your house. If you do not want to, or can not
do those things, and sleep with an open window-then except that there will be noise-of all kinds-no matter where you live.

I not saying it is okay-what I am saying is how is it that Roosters are banned from many towns, citys, and states, and hens too-yet everyone and anyone can have a dog or cat-and they cause many more problems then just noise? I am also saying that, while certainly any problem should be resolved without violence, and if both parties can work towards a solution-even better, but the person who is being bothered by the noise, needs to take the steps needed to solve the problem. Our laws are not always equal, or fair.
Examples:

I lived in an apartment while in college, and worked nights, the apartments above, below and on both sides of me had dogs, can you imagine the barking that went on non stop when the owners left for work, and left their dogs all alone inside their apartments, and I am home, trying to sleep-in the day time? I got some ear plugs, turned on some soothing music, and slept well-it was my problem to solve-not my neighbors-I lived in an apartment-I worked nights-everyone has dogs. If I could not find a solution, I would have had to switch to days or move.

In Texas, if your neighbors livestock is grazing on your land-you are required to put up-or-mend a fence to keep him out-not your neighbor-it is your problenm to solve.

I have to beg to differ with you on this. In some counties in Texas you are allowed to run the cattle at large. Though in others YOU the cattle rancher are required to fench in and maintain the fence. Unless otherwise agreed upon in a lease.
