Evening everyone

I have some unsettling news and hoping someone on here could help Jason and I in any way.

We had two unsettling calls come into the Sheriffs department on our animals by our neighbors(another military family) to whom obviously up until today had a great open neighborly relationship or at least so we thought.

Jason and I need to sell all our turkeys and ducks until we can fence off our whole property, something we were working on anyways but was slow because 1 time restraint 2 money... This is very upsetting to me and this morning when the deputy came out I was dumbfounded that they wouldnt come over and let us know they were having a issue with them, as they always said the animals were fine and not a bother and helped keep the bugs down for them... The kids and I always made it a point that if our birds were free ranging to far and not on our property we would go shoo them back home... and we let everyone know to please come get us or pop them in the butt with a bb gun...

When the second visit came a few hours later btw... to which my birds were on my property and I showed the deputy what we owned vs them and explained that a fence cant be built over night and if they have a problem then they should also make a fence of their own... I also apologized to the officer that he was having to come out for something like this and that we will make every effort to keep them contained...

But after going through the property lines and locating the pin stakes we realized that the survey for the property lines dont match up to the survey map and measurements... so needless to say that is going to slow us down until we can have any surveyor come out and hopefully fix the problem... I am not about to fence off if its not correct and then we be in the fault... if that makes sense. Because we are not equipped to allow our animals to stay contained to the 4 acres we need to either find a temporary home or sell them all off... Does anybody here have any suggestions... we are at a loss and feel like the neighbor trust has been violated... we take responsibility for our animals and will do what ever we can to keep them home but in our sense its like dont call on us for something that we can all work together to find a solution too... Jason and I are upset also because we truly did feel we had a wonderful neigbor relationship with them and now feel its been violated.

Any body here that could help us... I want to be a good neighbor but I dont like the fact that we arent given an oppertunity to fix the problem.

Not fair! No one invited me to the Okey blog! I lived in Sand Springs next to Tulsa for 3 1/2 years. I have to say that my fondest childhood memories are from OK. I say once an Okey always an Okey, just incredibly lost. I should have taken a right, instead I ended up in freaking CA.

NN is right raccoons can't produce saliva if you do get it you might consider calling the wildlife dept and having them come get it for testing I believe they still do that for tracking the cases of rabies in the state,
I had something just off my porch last night that was making a ruckus in the leaves and some cardboard thats there by the time i go the .22 and the flashlight it was gone I think it was probably an armadillo in which case I missed out on a future BBQ LOL They are really good for that

,
My neighbors across the road told me they spotted a fox at the edge of my woods a few days ago but no sign of one anywhere around the pens or coops but thinking it's time to reset the live traps again just in case.
I picked up 4 pigeon coops that were listed on craigslist and got a ton of extra stuff for pigeons I'm thinking that most of it will need to go to the auction for someone to get more use out of it than I will but all the feeders and such will be great to have around and use after they have been cleaned real well, I also got 3 more live traps and some great carrying cages, The coops on closer inspection are a little rough but will fix up nicely and will make better rabbit hutches than pigeon coops

That's a shame they didn't talk to you guys first before calling the law about it, You could just get a few T-post and some chicken wire and make a temp run for them so they couldn't wander very far till you get fences up that would hold them or If you need someone to just poultry-sit for a while if things don't get sorted out I would volunteer to help till you get things sorted out, it's just a thought not sure how else to help out so you can keep your birds.

Welcome, pull up a chair & tell us about your birds and anything else you would like to share, you have just found the best place on the BYC!!!

Barns I feel for you! Are you sure that it is the neighbors that you like that are calling?? Is there any possible way that you could set up a fenced area that you could keep them contained in? I'm sorry that you seem to be having a rough time lately!

Jeannie I have been on both sides of what you are going through.

We had some Muskovie ducks that went over and destroyed my neighbor's garden about mid-season years ago. Too late to replant and she had yet to get any produce either. But I filled her freezer with ducks and let her harvest my garden so she was happy about how all of that turned out.

Building a few pens will be the only temp. fix that I can see. And it is needed too with winter coming on. There is no way you can free range through the winter without very heavy predator losses. It will raise the feed bill but you will have to feed them out through the winter anyways.

The location of the survey pins should be good enough to build fence with. All a survey crew will do most of the time is double check measurements and locate the pins anyways. And usually property line disputes have to be settled in court so be prepared to go that far if need be.

When we lived in Enid we had the same issues with a farmer that let cattle graze on the property that we were leasing. And as a deputy told him that I didn't have to build a fence to keep his cattle out but he sure had to build one to keep them in. The deputy then told me I could round the cattle up in my corral the next time they were over on me and call him and he would arrange for them to be taken to the sale barn. We had new fences all the way around us the very next day.

The laws on fencing here in Ok can be found online. The site is down at the moment but should be back up tomorrow.

On this page go to Oklahoma cases citationized and I think it is under the topic Animals and Agriculture

And if I am reading this right then yes they can build a fece but they can also make you pay for it.

If such fence be not repaired or built accordingly, the complainant may repair or rebuild it, and the same being adjudged sufficient by the fence viewers, and the value thereof, with their fees, being ascertained by them, and certified under their hands, the complainant may demand of the owner of the land where the fence was deficient, the sum so ascertained, and in case of neglect to pay the same, for one (1) month after demand, may recover it by civil action together with one percent (1%) a month interest thereon.
