Nikki, no I do not think you should pay for the shipping either! It was not your mistake and the person that sold them to you stated she made a mistake. It is also a bummer that she is showing up with crossed beaks in her birds. I have some beautiful silver polish I hatched this summer -- people said they culled heavy on these bird and they have the best! Well I hatched a bunch of chicks with these birds so I know it was not an incubation issue but the hen and rooster I hatched from their eggs both have crossed beak issues. They have beautiful markings though!

Do try to get her to pay. She has admitted it was her mistake! Good luck~

On another note, those guinea eggs I pulled from the deserted nest gave me 17 keet so far. I still see movement in 2 more--not sure how that will go as I have not been turning them but they may have been far enough along. I have 2 polish eggs in the bator from this years girls and they have developed veins--yes, I know to early to candle and I usually do not candle this early but they have veins and I could even see movement--I love white eggs! Problem is I do not need more chicks right now! Anyone want a couple polish if they hatch? How about some guinea keets!!

I can only imagine how ticked off I would be. Personally, I do not give a rat's butt where someone tells me their stock is from, because you can never tell what else they have crossed into it.
Several things concern me.
- How did she correctly sex them at 8 weeks old?
- Crossed beak was sent to you, if this is genetic, it may run in her lines. If not, then I hope the birds are healthy.
- Has she actually shown her SQ birds, and where?
- I fail to see how it was an "honest" mistake. Did she not look at the birds when she picked them up to box them for shipment?

I would definitely NOT pay shipping. Her mistake is a big one. She should be paying to ship since it is HER error. Not yours. She basically sent you a defective bird, not what you paid for at all. I do not know of any reputable breeder that would not replace it on their own dime. (There may be some, but not that I know of)

I think we should start guessing now how many chickens the two of you will come home with and see who comes the closest.I'm sure there some great stories will be coming from that trip.

None!!! None!! Uhm...none...none...maybe a pair, or 2...hmmmm don't tell DH!

Nikki,
I have had something like this to happen from someone here on BYC. I actually bought the birds off of another auction site but know her name now and know she is on BYC a lot. Several years ago I bought 2 pullets, around 8 months old and paid to have them sent down here. As soon as I opened the box I saw that one was a roo!
I bought them for pets, not for showing so those aspects didn't concern me but I did not own an incubator back then and was wanting to use these girls for this. The breeder was a pain to deal with once I told her and I wanted a refund for that one that was a roo. It was sooooo obvious.
She said she didn't have any money to refund me right then but would the next month. Then I caught her buying eggs from several breeders and again demanded my money back. She certainly did not want the roo back but I finally got my money and have learned since that she has done a few folks wrong. No wonder she is often ignored or shunned on some threads here. I try to let others know about her and hope she isn't the same one you are dealing with. She breeds and shows Silkies as well as another breed, maybe more but I know only of those 2.

Nope, would not pay to have another shipped and would certainly see about filing charges against her if she refuses to send you a replacement for free. And by golly, let anyone you talk to in private know her name so others are not taken in!

When I ship birds out I make dag gone sure I am sending exactly what they paid for. I photograph them before I sell them to them so they can see them well, I photograph them going into the box and with all the fruit they have in there for the trip and document, document, document. I hate arbitration but have been there so many times that I have learned to be as careful as possible.

I hope you can get this squared away and am so sorry this happened to you!
