Stolen Horse--Man is BACK in jail!

When I talked to him...he was ON probation. (Yesterday when he called me.)

Does anyone know any information on something called a "civil stand-by"? It's a document signed by a judge that calls for an officer to stand with you while you retrieve your property. Does anyone know if I have to have a suit in place before I get the civil stand-by? I tried calling the DA but then re-remembered that it's VDay.

Don't know if it's the same everywhere, but...

FAQ - What is a "Civil Standby"?

Question: What is a "Civil Standby"?

Answer: A Civil Standby is a situation where the police officer stands by to keep the peace in a situation involving a civil dispute, not a violation of the law. It is very common in domestic or landloard/tenant disputes, where one party wants to remove his or her property from a dwelling for example. One of the parties will call our department and request a stand-by. The officer stands by and tries to insure that the move is done peacefully. The officer is a neutral party in such a case, however he or she may take action if one party assaults another. http://www.fostercity.org/FAQs/civilstandby.cfm

"Civil Standby" gets tricky when there is a resposession involved.

Taking an officer without also having obtained a repossession order may be viewed as acting "under color of law" and could be construed as a violation of the other party's right to due process.

I'd go back to talking to an attorney about this before I'd risk giving the guy with your horse any wiggle room.

Maybe his past is what caused the officials to give this story a better look. Whatever it takes!

His past should have made them take a closer look from the beginning. Unfortunately, it was probably his past that made them want to look the other way. People like that are trouble and a lot of paperwork.

He's had too many free passes. It's time to lock the bum up.

On a side note, I'll bet he has mean dogs that run loose and kill chickens too.

Interview ain't gonna happen. The reporter just called and said he had to go on a crime case today and that the editor said there was no time for it. Either way, having people call the sheriff's office to find out what was going on did wonders I am almost certain of it.

The reporter said to call when I was trying to get possession of the horse and they would try to send someone out to video it.
