Stolen Horse--Man is BACK in jail!

Oh, forgot the censorship thing...

I wished I had saved it...a good tirade about if I ever have the misfortune of rolling through that town I'd fully expect to find Rosco and Boss Hogg sitting at the HootnToot diner, planning the results of the next election.
And a few added reasonable facts like canceled hearings, family ties and conveniently absent court reporters.

Is the DA pursuing theft charges? Once the horse left the property he was contracted to remain on, it should have been considered theft. If Tammels knew of it, he could be charged with receipt of stolen property. Even if he didn't know, he can now be charged with possession of stolen property. Both are criminal charges. You can not legally buy stolen property and claim ownership to it.

Several questions:

1. Did the preliminary hearing (which I thought already took place in December, the one with no court reporter there) take place yesterday on the embezzlement charge?

2. I left a strongly-worded but polite (ha ha) message on the newspaper comment page--forgot to save it, durn it! I emphasized that NATIONWIDE PUBLICITY was what we were going for now in order to rip the lid off their nasty little town. Not those words, but the meaning was clear.

3. I think you need a lawyer. It's clear you are not going to get anywhere without one. I don't know whether you need a lawyer to file a writ of replevin with the court. It is a process for recovering property or chattel which was taken from you. Google it. On the other hand, you don't want to slow things down more (if that were possible).

Keep us posted. Love and hugs and best wishes to you.

Comment left at newspaper link:

This is the perfect time to apply some tough love for this seven year old so he may learn a life lesson and abide by doing the right thing that the legal system and his grandfather do not seem able to do.

The child should not be in possession of stolen/embezzled goods - the horse, end of story.

Why be rewarded with keeping the horse that DOES NOT belong to him? Is this what we teach our children these days?

Has anyone actually seen the horse and what condition he is in?

Step up to the plate and do what is right, return the horse to the rightful owner and be a better person when you grow up.

This is something the parents/grandparents should instill in this child especially when it appears the court seems to have one delay excuse after another.

Where are the transcripts for the ownership hearing?

Why so many delays?

I posted the link to the story on my FB page:

Karen Skipper Lockhart I urge all my FB friends to post about this. The girl that owns the horse is on a forum I belong to, this is absolutely ridiculous that this has been allowed to drag on as long as it has. Clearly the laws in Oklahoma are different from laws in any other State!

Embezzlement case involving horse continues » Local News » Tahlequah Daily Press

TAHLEQUAH — Court records show a Tahlequah man is scheduled to be in court this afternoon on embezzlement charges. Michael Dewayne Ryals, 22, will appear before Special District Judge Holli Wells for a preliminary hearing at 1:30 p.m. ...

Here is what I wrote the Tulsa News:

To Whom It May Concern:

Why do the wheels of justice move so very slowly and ineptly in Tahlequah, OK? Ms. Mikeala Rodriguez has been trying to recover her stolen horse from two men for over 9 months and has run into nothing but excuses and roadblocks with the local justice system. It reeks of corruption.

It would be commendable if your news team would shine some light on this disgraceful case, and put some pressure on these villians and the court system that is protecting them.

My comments are showing, kinda surprising. I'm listed there as KMarquardt. The reporter's sympathy is obviously with the person who has Max now. Saying that "Rodriguez also still claims ownership of the horse", pretty much says how the article's author feels. I can't take a leased car and sell it someone else without it being theft, I just don't get why this is different.

What's up with this attached to some of the comments?

{EDITOR'S NOTE: MRS. RODRIGUEZ HAS BEEN GIVEN HER CHANCE TO COMMENT. WE URGE THE PERSON WHO IS MAKING REPEATED POSTS UNDER FALSE NAMES FROM THE SAME IP ADDRESS TO FIND ANOTHER OUTLET FOR VENTING.}

and this

{EDITOR'S NOTE: We have received more than 20 comments from what appears to be the same IP address. Though we have posted a couple of these comments, we will not post the rest of them because they are redundant.}

Was this just a mistake because we weren't seeing the comments? Did somebody try to post over 20 times or is this just more bull?
