You bought it off ebay. The seller is required to get you the item in the condition you purchased it. INSURANCE protects the SELLER, not the buyer. Unfortunately for the SELLER, the item didn't get there in the condition he sent it. Sellers often OFFER insurance to the buyer, and then take a risk if they don't buy it. But it does not get them off the hook.
File a SNAD with ebay (significantly not st described). That is what the whole PAYPAL protection is for, as well. You may be asked to return the item to the seller, but perhaps the photos will serve the purpose.
