I mean absolutly no disrespect to you, but I disagree.

If I am going to sell something on ebay, or anywhere else for that matter, I am not going to use a picture of someone else's item, regardless. For instance, it'd be like me selling a 2010 chevy truck, and using a picture of my neighbors 2010 chevy truck because it's better looking.

And I mean no disrespect to you but I think that you might be surprised at how many people are online and haven't a clue as to what is allowed and what isn't. What did they say when you asked that they not use it? Hopefully, it will be taken down without anymore hard feelings.
In other words if they see it on the web and not watermarked then they think it is free to use. It may have just been an honest mistake. I'm just sayin'

Can you be more specific as to where this is? Ebay is not always user friendly when locating such things.

Here ya go:

http://pages.ebay.com/help/sell/sharing-content.html

"Sharing and using content
For the convenience of sellers, we offer a product catalog of photos, item descriptions, and specifications, which are provided by users and/or third parties. Sellers can use content from this product catalog when creating their listings.

We might, at our discretion, use photos that you upload to your listings to represent a product in our product catalog. If we do, we’ll display your user ID and a link to your My World page on the product details page of the product featured in your photo.

All photos in all listings will be automatically reviewed for possible inclusion in the catalog, unless you opt out of this program. While there’s no guarantee that any of your photos will be selected, you may gain valuable exposure in the catalog if they are.

If you don’t want us to consider your photos for inclusion in the catalog, you’ll need to opt out. You can opt back in at any time if you change your mind.

Opting out

Click My eBay at the top of most eBay pages and sign in.

Click the Account tab.

Click the Site Preferences link.

Click the Seller Preferences link.

Click the Show link next to Share your photos.

Click the Edit link next to Consider photos I upload in the listing process for inclusion in the eBay product catalog and other product offerings.

If you want to opt out, click the If you'd like to opt-out of this program, please do so by checking this box and clicking the "submit" button below check box.

Click the Submit button.

If you later change your mind and want to opt back in, uncheck the box in step 7 before clicking the "Submit" button.

What you should know
All photos you upload to listings may be selected for inclusion in our product catalog, unless you opt out of the program. You can’t selectively choose which photos you want us to consider for inclusion in the catalog.

If your photo is chosen to represent a product in the product catalog, the link to your My World page will be available for as long as we use your photo to represent that product in the catalog.

You won’t receive any notifications if we select your photos. However, you’ll see an attribution to your user ID and My World page under the product description on the product details page of the product featured in your photo.

All photos collected while you’re opted in may, at our discretion, remain in the product catalog after you opt out. All photos and other content uploaded after you opt out won’t be included in the product catalog.

It’s important to comply with all eBay policies, including our rules about intellectual property, when you create listings or use our product catalog.

Learn more about using product details from our catalog."

This is a private dispute and needs to stay that way.
We do not bring conflict from other places to BYC and we never ever flame and call out BYC members on open forum.

All disputes need to stay private.

I think most of you are aware of that.

Thanks.
