I think that the best thing to do is bite the bullet and hire a good attorney. Then counter sue and get your legal expenses paid. Once you have an attorney, he will most likely drop the case. Right now he is just being a bully and trying to punish you for something that was his fault.

I am so very sorry to hear about your troubles. I can't rememeber everything I read in the earlier thread about your original action, but a phrase in this thread caught my eye.

For you to have intent to kill a dog on the run with a pellet gun and a shot to the heart, would you not have to be a crack, sharpshooter with extreme skill and training, kept current by hours of target practic at a range, with moving targets on a regular basis? Without that, I don't think you could reasonable expect to drop the running dog in its track with a single shot from a pellet gun. Since you didn't think you could do it, BECAUSE YOU DON"T HAVE THE SKILL TO DO SO... you could not even have the intent. You could WISH it would happen, but I don't think you can reasonably intend for something to happen which you are not normally capable of, which brings it back to the accident level.

I'm no attorney, but some times I think that is what I should have persued instead of nursing. Good luck, and DO keep us posted. Let us know when and where to send letteres and emails and phone calls showing community support for you. BIG hugs from so cal.

Hello to all again.
Does anyone out there have any expereince writing an answer to summons?

Can you in writing an answer well have any chance in having the case dissmissed?

Attorneys want all the money up front.
There are no incentives for an attorney to write an answer that gets the case thrown out.
Today one said he would have to have $5000.00 up front and he believes that it is going to cost much more. 90 percent are settled out of court is what he has said. But many letters and research goes into fighting to prove you justified.
And even if I win they tell me I was justified, I could never be paid a dime if the loser does not pay and then you have to fight for that.

As for the state insurance commisioner I called them this morning...

They said that most likely they are going to find that the wording in the policy from farmers is nothing more than a lope whole to get out.

They have seen it before and even if it is found that they have done it wrong it takes 60 days to look this over and I do not have that long.

They could get fined but that does not go to me.

they have seen policy wrote in just this way even if it is just an alleged act...

be sure to double space each line of text in your answer, also address each issue they brought up by number, or letter.

and yes if your answer shows the judge you were justified he might throw it out before it really begins.

Won my custody case with just an anwser to the request for modification......Judge said "Case dismissed no changes necessary."
