Ownder Defends Business

Yup, why do you think the smart ones try their level best not to leave any evidence when they off someone?

That's the one crime (depending on state of course) that, if convicted, you get a life (or death) sentence.

Just about any other you get out, make a deal, etc. But you get tagged for murder and you're done.

Personally I think pedophilia outta rank right up there with that... it's a fact that that is a (mental) wiring problem, NOT a plumbing problem, so even (voluntary or involuntary) castration won't fix it... it cannot be fixed... the next victim is only delayed. Just like culling a warped roo that won't quit hurting others... or a dog who's rabid... nothing to be done but protect others, and do it as cleanly as possible... much as I'd like to see the buggers really feel some pain, the quicker they're gone the safer the population is.

BTW, why didn't anyone tell me I added a D in Owner in the title... really, The Ownder did it...
OY, what a dunce... they need spell check for titles...

soooo right on that!

thats the wonderful thing about the Castle Doctrines. Those folks were in the process of stealing his property. Unless they can prove otherwise, they have absolutely no case to sue him. The doctrines specifically spell out that if an owner opts for lethal force, then he will not be held liable for injury to those he shot.

Didn't we used to hang horse thieves back in the day? Didn't thieves used to have one hand chopped off so they couldn't steal again? I know it sounds harsh, but as a country we are soft on drugs, we are soft on crime, and the nuts are running the madhouse.

UPDATE... http://www.dentonrc.com/sharedcontent/dws/drc/localnews/stories/DRC_Sheriff-Grand_Jury_0707.118dde276.html

O'Shea
was released the same day, to go straight to jail charged with theft.

Prescott was listed as critical but was upgraded and given a private room Tuesday. As soon as he's released they plan to arrest and charge him with state-jail-felony theft.

Mike Starr, the owner, is being summoned before a grand jury to see if they feel a crime was committed.

" State law has long provided legal protection from the use of deadly force to prevent arson, robbery, theft or criminal mischief at night, or to prevent a suspect from fleeing if the property owner “reasonably believes the land or property cannot be protected or recovered by any other means….” According to the Texas Penal Code.

The protection was eroded in the 1970s when legislation referred to an obligation to flee if possible or to ascertain whether the suspected person was armed. But in September 2009, the so-called “Castle law” broadened the protection by eliminating the obligation to flee, extending the area of protection to a person’s vehicle and business and also protecting against civil liability. "

Based on that, he had every right to blow them to kingdom come for bothering his business. Add to the fact that his apartment is in the same building means they were also violating his home. Either is enough in Texas to justify the shooting. Hopefully this has been published enough that thieves will think twice about robbing that business... and hopefully others... in the future.

An armed society is a polite society.

If everyone just assumed everyone else was armed, I think less air conditioners would get stolen.

Oh well put. I can tell you if I find an intruder in my house I'm darn sure going to assume that. It would be flat out negligence not to.... 'oh well they're ONLY going to rob the place I can go back to sleep"... that's just NOT a safe thing to do.. too many psychos running loose.

I heard of some cases that just made my blood boil. One of them was about a man who was breaking into a car to steal it. He broke the window and badly cut his foot on the glass. The would-be thief SUED THE CAR OWNER and a jury awarded the criminal over $30,000 for his "pain and suffering".

When juries stop handing out rewards like that, and when they stop issuing ridiculous sums in punitive damages because they think the companies have "deep pockets", it might be different. We desperately need some tort reform in this country! I know there are many, MANY cases where punitive damages is the only way to hit some corporations or entities "where it hurts" because they knowingly flout the law or ignore it. There are, however, far too many judges and juries who have swallowed the notion that "it must be somebody's responsibility". If I am running with a screwdriver, trip and fall, and stab myself, it is MY FAULT, NOT the fault of the company who made the screwdriver, the truck driver who delivered it to the store, the stock person who put it on the shelf, the cashier who rang it up, or the manufacturer of the car I drove to the store to purchase the darned thing!!! When did we decide to become a society that not only tolerates criminal behavior, but in some cases such as the one I referred to above, literally DOES reward it...

Dissenting view here:

I don't think an air conditioner is worth a human life.

In this case, it wasn't. It was worth two.

This country was built with guns, guts, and God. I find it terribly unforunate that so many people have forgotten that.

Nope, not just ANY somebody... it has to be somebody other than the one suing... that's the key. I was thinking on this the other day... like my sis... she blames mom for everything... mom in turn blames Gran for everything... now Gran she took responsibility for her own choices... but it could go on forever... so... if the blame is always passed back a generation is ANYONE ever to blame for ANYTHING? One of those weird paradox type things that sneak up on me at 3am...

... Maryland Toleration Act... I think it's sad so many have forgotten that laws like this were on the books and enforced... and that the Constitution put a stop to it.

mom'sfolly :

They were not in a house. They stole the units from outside a business....just saying.....

My neighbor has threatened to shoot my chickens. Legally, I could shoot a dog that was killing livestock but I don't think I'm allowed to shoot a human for it. Does that mean that I value my chickens any less just because they are outside my home??? NO!!!!!!!! My next home will be in Texas!!!

If you the criminial don't value YOUROWN LIFE enough to behave right, then WHY ON EARTH should I value your life above what you do????????? I'm not sayin, I'm just sayin.
