I agree.. its still the landlords house...
if they want to LET a person smoke in the apt.. all good.
But if they dont... the renter needs to respect that...
I know a lot of places now are saying no smoking allowed..etc.. in the rental agreements..

We have had smoking bans for so long it is shocking to go to another state and see people smoking in a public place. Here you aren't aloud to smoke within so many feet of doors to public places, no smoking at all on hospital or school property. Absolutely no smoking in any public spot,..thank goodness. Apparently WV isn't as far behind times as some think. Being an ex-smoker I always thought it was rude to fire one up in a public place anyway. If you can't wait a few minutes and go outside or even wait till you get home,...something is wrong.

In most states, it is only illegal to sell tobacco to a minor. There are no laws against the minor who does the purchasing.

If an officer saw a minor with a beer in his/her hand, there'd be a ticket issued....not so for tobacco.

Tis true...
A parent or guardian would have to hunt down the person that SOLD tobacco to a minor to get a charge aganist the seller...
Otherwise the cops do nothing if they see a kid smoking... weird, i know!

Very.
Almost as weird as being at a small town rodeo last year where a Skoal van was parked giving out free samples of *gag* chewing tobacco to those over 18 with ID. Yaaaaa. Riiiiight. Some of those boys were barely old enough to know how to ride a bicycle, let alone a bull. =/ And my fav was the girls getting samples for their little brothers.

When my uncle died, he left his things to me. I had to clean out his apartment and bring it back to my house. As I was cleaning stuff up, I was amazed at the brown-yellow grime that everything was coated in from all his years of smoking. I can only imagine what the landlord had to deal with because the apartment did stink and I'm sure everything was stained.

I remember as a kid when I'd visit my grandmother in the city, I'd get bored so she'd send me to the corner store to buy her a pack of Pall Malls and a Boston Herald. She'd give me a dollar, I'd buy both and have change for candy! Not to mention nobody cared that I was 10 and buying cigarettes....

My mom was a heavy smoker, and exposed me to a lifetime of second hand smoke. I worry about cancer from all that exposure, and feel that children of smokers should be protected somehow. I think it should be illegal to smoke when a child is in the car.
Growing up watching my mom smoke, I always thought it was gross, and never had any desire to do so my self. I think bans in government buildings, etc,are fine. Restaurants and private businesses should be allowed to choose for themselves. As a customer, I simply wouldn't patronize those establishments.

You got me trying to remember what the candy cost now... I think the paper was a quarter, but that would mean the cigs would have to be less than 75 cents in order for me to have change for candy.... I'm not sure of the breakdown, but I do know I could get a pack of cigs and the newspaper for Gram, and still have candy too, all for a buck. I'm not even sure if someone would tell you the time for less than that, never mind the news....

We have THOROUGHLY enjoyed California's smoking ban for better than a decade now. It's been EASILY 20 or 25 years since you could smoke in a restaurant here. When I was a child, one of the reasons I grew up and smoked was I craved it... walked around in the 1960s and 1970s breathing in the smoke of adults around me. I was likely addicted to tar and nicotine by the time I was 11 or 12 years old, even though I'd never had a cigarette. I smoked for years but have been 100% tobacco-free since March 3, 1998. The ONLY time in all those years that I even thought about having a cigarette was when my Mom passed away in 2005 (she was diagnosed with cancer and was dead in under a month--it was really hard). But.. I knew that if I had just one, I'd start again, so I leaned on family and friends and got through it.

To this day, as an ex-smoker, I get very queasy to my stomach when I have to inhale someone else's nasty cloud of smoke because they're doing so in a public place.

I think banning it in areas where people bring their children and all public buildings, hospitals, and businesses is a good idea. California does have some really stupid laws on the books, but we are also pretty forward-thinking in a lot of ways out here and recognized the health risks of second-hand smoke long before most states.

I also think smoking should be banned within 20 feet of a business entrance. We were going to IHOP once to have breakfast, and a smoker was outside on the bench having a cigarette, 5 feet from the door, and blew the smoke RIGHT in my step-daughter's face and made her cough AND she smelled like a cigarette for the rest of the day. She was 9, and that was unfair.

We cannot legislate people into being considerate, so we need to ban behavior that puts other people's health at risk. Banning smoking in public places is a really good start.
