Stolen Horse--Man is BACK in jail!

He wrote up a deal that said the man has to spend 60 days in jail, on weekends no less, and will pay $2,000 (back monthly payments plus attorney fee and vet check). Apparently the man looked at it, said "I can't spend 60 days in jail, I have a kid!" and snubbed it.

Notice that he didn't nix it because he claims he's innocent. He nixed it because it wasn't convenient!

At one time, in Colorado, you could string horse thieves up on your own property. I wonder if that Law is still on the books.

Good luck, but I think things will come out just fine. They sound like a bunch of idiots!!

It concerns me that the "deal" didn't also include the return of the horse!

Ropo - If I were you, I'd be there for the second part of that hearing, and any other procedure you can be there for. You may be needed to clear up questions. Besides - if you aren't there, who will keep us updated?

ROPO..just make sure that any money he is ordered to pay you does NOT mean that his uncle or he gets to keep the horse.... If he pays you $2000...is that buying the horse? If so..then you'd have no more claim on the horse??....i dont know..just an idea to check out....

Unless the op is under a gag order they won't have a leg to stand on. Now if there is a gag order things could get sticky.

I have not read this thread from the beginning so I do not know the details. From what I have read it sounds like Max is involved in a civil matter over ownership, the owner has been to court and has a court order to regain custody on December 16th. Am I even close to right?

We go through these situations often at Stolen Horse International and have all kinds of victim horror stories to tell. I do hope you get Max back on the 16th and a deputy should go with you when you go to pick him up.

We had another case similar to this situation and it didn't work out like the court order ordered. In this case the horse was not there. We have seen it happen many times. And surprisingly nothing happened to the person who had the horses and they had to go back to court to enforce the court order. I don't know what state you are in but the laws in WI worked terrible for the victim.

I wish you luck in getting your horse back and hope all goes well.

I'm sorry guys, I haven't been able to read all the responses, but I have a question...

December 16th if the judge rules that Max is to go home, if he is delivered in a physical condition that is less than what it was when you last saw him - I think you should request more money for additional damages.

(I hope I said that right... I don't begin to understand legal-speak)

The way understand it...the 2000 is for the leased months he didnt pay and yes the hearing the hearing on the 16th is to establish ownership...which is Ropo ...the original lessee sold the horse to his Uncle and is currently in jail...health of said horse is undetermined at this time..however yes you should ask for more monetary damages if his health isnt up to standards!
