Stolen Horse--Man is BACK in jail!

I have been reading this thread from the beginning. I have been hopeful that this horse will get home.

I hate to say it, but in reality at this point I am afraid that I would NOT expect the horse to go back to the original owner. At most you are probably looking at receving the monetary value of the horse. From a legal stand point the horse is property, not a pet or something that is dear to your heart.

I disagree, Matt. Since the horse is property and her property has been stolen and the property is not even that many miles from her, I would expect to have the horse returned, if she can get a reasonable hearing. The property is so clearly hers and she has so clearly been wronged any other out come would a ridiculous miscarriage of justice.

I really hate to reply and have a conflicting opinion----but

I do not think she will ever see her horse again, at best I think she may get a ruling to have the horse returned. But then the judge is going to turn around and rule that she has to pay for all the feed, and upkeep the horse has recieved from Uncle So and So.

I stress that I am not trying to call names, point out mistakes, or anything like that, but it may be time to face reality. The court case has been put off how many times? How many judges recussed? Wasn't the case heard and then the judge recussed? Politics, right or wrong, reality sucks.

If you guys want I can get on the band wagon, write letters and all that stuff. I do not see this ending happily for the young lady or the horse.
 
I do not think the judge would have her pay for the upkeep the whole time when the horse is knowingly stolen. If the horse is deemed in poor shape, the judge can grant her the expenses to get him back where he should be prior to leaving her farm. Most judges would ask the owner if they want the horse back or have the guilty party pay for the purchase price of the horse she quoted. The judge should enforce the rulings if the guilty party does not follow up the demands and they would end up more trouble with the law than to begin with.

It has been dragging out this long, nothing really being done by getting a lawyer (same for the dog bite in previous forum she posted), it is going to be a very expensive endeavor.
