First and foremost, from this point on, be safe. I just think you can't trust almost anyone in that town, including the sheriff's office. I just don't know that you going out and searching his property without knowing for sure Max is there would be any help and I can't bare the thought of you potentially being in danger. This family has proven over and over that they have no concern for the law or for what is right.

I really believe they had to have known this could be coming, in which case there is no reason to believe he is being honest about having just given Max away last night. They probably hid that horse weeks, if not months ago. I just don't know that it is of any use to put yourself at risk going to this guy's property without knowing for sure that the judge saw Max and the horse is still definitely there. I honestly doubt at this point that the judge even went out there.

I truly hope and pray that this judge steps up and does the right and fair thing and has someone do this for you, go out and collect the horse and take it to an undisclosed neutral location for you to pick up so that you are not put in harm's way. Really, I don't know what the judge is thinking the way she has handled this. That man deserves to pay for this. I hope they lock his sorry butt up in jail for a long time.

Here's something interesting.

The DEPUTY told ME that he had never been out to the uncle's property. Then he stated that he was not the deputy that took the judge out there and that he doesn't even know if the judge WENT out to the uncle's property.

I called the DA with this information and they said "That's not the information he gave the DA this morning." The DAs office also insisted that they judge HAD gone out to visit Max. I have every reason to believe the DA and no reason to believe the deputy. You can guess who I am believing based on this information.

That being said, the local TV stations won't do a story without hearing from the other side, which another poster stated that I will indeed look like the bad guy. HOWEVER, I will be taking out a full page ad in the local newspaper. I have already posted my comment regarding help finding Max on the online version of the Daily Press so I hope someone comes along that knows some information.


Regarding the "writ". Apparently a "writ" is different than a search warrant. The writ grants me the right to go into a KNOWN space where the property I am after is known to be. A search warrant is given when an item is suspected to be on a certain property.
 
It's a little late in the day, but now that you have the court's judgment that the horse legally belongs to you, what about offering a reward, big money, I would think at least $500, payable to the person who comes forth with information leading to the recovery of the horse by midnight Saturday (payable to anyone EXCEPT uncle, nephew, and other family members who are in cahoots)?

That might loosen up some tongues. Somebody might need the money more than they need to stay friends with this guy. Somebody will turn him in. It's a mighty small town, and you have the weight of the law on your side.

I've, too, have been silently following this fiasco. Unbelievable.

Isn't it time to call Net Posse again? Wasn't the only reason they couldn't get involved before because the court was still deciding if Max belonged to you? Now that the court has ruled the horse is yours, they can help, right?
 
Uncle wouldn't need to come on here for a head's up... half his dang family probably called him with the news within minutes... why wait hours until RoPo has a chance to update us?

How in the WORLD is this guy still walking the streets? You would think that the cops, DA, judges, etc would WANT the guy gone before more people get robbed.

That place must be the handbasket capital of the country.

Edit... wait a second... if they know he's given the horse away that means they've already talked to him... so WHY isn't he in jail if they've already talked to him today and he admitted to committing additional crimes? I think I missed a step.

Ropo, a Judge is ALWAYS available to sign warrants- even at night and on Holidays! My retired-cop hubby told me this. He was a cop for 28 years. GO GET THAT WARRANT!!

OY, this whole situation is maddening, but to have the entire justice system from cop to judge so completely apathetic just scares the crap out of me...

Just what exactly do they consider a crime worth the trouble of prosecuting? Or, better yet, preventing?

Why in the nine hecks did they not have someone out at his place when they knew the judge would rule in your favor... obviously the uncle knew, thus not showing and giving the horse away... and given his lying thieving history why didn't they keep an eye out... it would have prevented them work... prevented them having to hunt him down, hunt the horse down, extra warrants,etc.

What's that line about an ounce of prevention?
